reduced to a 17' depth if they overhang a 6' wide walk or landscape strip
(Sec. 3.2.2(L)(4) of the LUC). The plan indicates that the width of the
landscape strip is only 5, therefore the parking stalls need to be 19'in
depth.
A modification is being submitted with this submittal.
Comment from Current Planning:
The abutting property owner to the east has requested that in order for
compatibility to be achieved, a new six foot high solid wood privacy fence
needs to be constructed on the applicant's side of the property line. Such
a fence will contribute to buffering the headlights of vehicles using the
driveway. In addition, the applicant is encouraged to plant three evergreen
trees on the east side of the property, subject to receiving permission from
the homeowners' association.
A new 6' high masonry and wood fence is being proposed. I addition to the
fence the applicant has increase the width of the landscape buffer along the
portion of the east property line that abuts the residential properties. Refer to site
plan and landscape plan.

of your site indicates directional ramps, which are to standard, that align
with radial ramps to the south and west. This creates an awkward
maneuver and could be mitigated by moving the directional ramps closer
together to reduce the offset currently created.
Proposed ramps have been moved to align as close as possible with the existing
ramps.

required elements needed to justify the variances. Please review LCUASS
1.9.4 and include all required elements. Mike Herzig will be glad to meet
with you to further explain what is needed. One key item is that you, as a
PE, need to explain why, in your professional opinion, the variance request
should be supported, and if it has any effects on public health, safety, and
welfare, City maintenance costs, and design life. It is not enough to say
that certain City staff thinks it is ok, therefore it is ok. It is fine to reference
outside materials (i.e. the letter from the planner regarding the sidewalk),
but the engineer must still provide analysis and a recommendation.
Also, please remove the setback item - it is a planning item and is not
covered in LCUASS.
[3118105] The variance request for driveway separations on Lemay needs to
be rewritten - it NEEDS TO ADDRESS OAK RIDGE to the north, and the
church driveway to the northwest, which is very close to this proposed
drive cut. Safety, health, and welfare of the public needs to be addressed
as well, and the request needs to be stamped. It might be helpful to review
LCUASS 1.9.4 for the items needed in a variance request.
It is the City's intent to grant the variance once the revised request is
received.

We have reviewed the staff letter dated May 15, 2005 and have the following
comments: Please note the site plan and building plan have been completely
redesigned since conceptual review.
ITEM: 131-Bed Nursing Home at 4824 South Lemay Avenue (Rule
Property — northeast corner of Lemay Avenue and Rule Drive)

[5110105] 1 received a draft of an easement (for detention pond installation
and maintenance- a temporary construction easement and a permanent
maintenance/repair easement), a sketch of a proposed easement (for a
"storm sewer easement" which doesn't seem to be included in the previous
easement language), and a legal for that easement (but titled as a
"construction easement'). To go to hearing, a letter of intent from the
adjacent property owner(s) stating that they intend to dedicate the
necessary easements for this project to go forward, is still required. Also,
please provide all the exhibits referenced in the draft easement so that we
can understand what is being proposed. This offsite easement will need to
be public, too. I have attached the City's standard deed of dedication for an
easement (with P and Z acceptance). Please use this language for the
offsite easement.
