Re: Sunrise Ridge Second Filing Modification Request
Dear Mr. Shepard;
This letter serves as a formal modification request for Sunrise Ridge Second Filing. The
variance request is from the City standard for Urban Estates lots that the lot frontage at the
setback line be 100-feet minimum.
There are seven lots within this subdivision to be constructed around the proposed cul-de-sac.
Three (3) of the lots (1, 4, 7) have adequate frontages and also adequate building envelopes. The
remaining 4 lots (2-3 and 5-6) were severely restricted by this requirement in terms of the size of
the building envelope and the required length of driveway to reach the house at the setback lines.
Refer to the attached exhibit for additional detail regarding the setbacks and lot frontages at the
setback line.
Therefore, on behalf of our client, we are requesting that the City grant a variance from the 100-
ft width requirement and reduce the required width to 50-feet for Lots 2-3 and 5-6VThe front
yard setback is 30-feet, which provides a minimum of 50-feet of lot frontage at the setback line.
In addition we are asking that the side yard setbacks for lots_ 2_adjoining Tract A be
reduced from 20-ft to 10-ft to, increase the buildable width of the lots. We also would like to
request that the sideyard setbacks for Lot 2 (south side) and lots 3, 5 and 6 be reduced from 20-
feet to 15-feet. The purpose of these requests is to minimize the driveway length required to
reach the houses. If there are any comments or questions concerning this modification request,

calculation indicates that the right-of-way associated with Rock Creek Drive
and Sunglow Court has been netted out of the gross.
Only right-of-way for Strauss Cabin Road is to be netted out since it is an
arterial. Right-of-way for collector and local streets do not get netted
out.
4. The scale on sheets 1 and 2 of the Site/Landscape Plan is really 1 inch
= 40 feet, not 50 feet.
5. On the plat, a Notarial Certificate is not needed for the signature of
the Director of Planning.
6. On sheet 1 of 2 of the Site/Landscape Plans, please add a signature
block for the Owner with a Notarial Certificate. The language for the
owner's signature shall read:
The Undersigned Does Hereby Certify That I/We Are The Lawful Owners Of The
Real Property Described On This Site Plan And Do Hereby Certify That I/We
Accept The Conditions and Restrictions Set Forth On Said Site Plan.

Hello Kelly, in writing my Staff Report for next Wednesday's hearing, a few
issues have come up that need clarification.
1. Mark's narrative for the Minimum Lot Width Modification requests a
reduction from 100 to 75 feet. And yet the way I scale the drawings, it
appears to me that you need to ask for a further reduction to 70 feet.
Lots 3 and 6 are depicted with front building lines at 72 feet from front
property line, not 75. It would not be a substantial change in the Request
but it just looks to me that you want to be as accurate as possible. We can
support 70 feet with the same justification as 75 feet. Otherwise, the
building permit applicant will need a Minor Amendment.
2. As you know, Tim Buchanan has asked for mitigation trees. These can
either be placed on the Landscape Plan now before hearing, or made a
condition of approval. Final Compliance Plans would be required to show the
mitigation trees based on Tim's recommendations.
3. We need to make a minor correction to the density calculation under the
Land Use Summary on sheet 1 of 2 of the Site/Landscape Plan. The existing
