Bethany Drive Suite 113 Aurora, CO 80014 Dear Tom: This is in response to the application for a vested rights determination for the Waterstone Apartments project which was filed on December 23, 1997. It is my determination that the application is not complete. As provided in Section 3 of Exhibit "A" of Ordinance 161, 1996, processing of the application will not proceed until the missing information is provided. The following items must be provided for the review of the application to continue: An additional $2,500.00 (see Section 2, Exhibit "A," Ordinance 161, 1996) . I have informed Doug Wagner of this requirement in a previous telephone conversation. When Doug and I first discussed the vested rights determination procedure, I mistakenly referred to the application fee contained in the Land Use Code which is $2,500.00. This application is being processed under Ordinance 161, 1996 which has a $5,000.00 fee. I agreed to proceed with the determination of completeness since this was my error. However, additional review will not occur until the remainder of the fee is provided. An indication of the effect that the application of Ordinance 161, 1996 would have on the applicant's existing development loans (see Section 9(f) 'of the Ordinance). While the applicant provided information pertaining to the total investment made in the project, there was no discussion relating to any development loans. 281 North Collebe Avenue • P.O.
