We will be boring a sewer service line under the BNSF Railroad track. We are working
on obtaining the proper easement, and anticipate the City will require a letter of intent
prior to hearing.

5. A soils report:
We are not proposing any street or alley improvements, therefore it is our understanding
that we may not need a soils report. In the event that it is needed, it is our
understanding that it would be subject to final compliance review.

8. Explanation of any know modification request(s):
A. We submitted a request for Cameron Gloss to increase the height limit in accordance
with the "modification of height limits" process outlined in section 3.5.1(G) of the
LUC. It is our understanding that Cameron is supportive of our request, and will be
rendering a formal decision soon.
B. Also, see the attached modification request to reduce the required off-street parking
from 31 to 21.
9. Reguest(s) for any known engineering variance(s):
We are detaining and treating the roof water for water quality, however we are
requesting a water quality and water quantity variance for the water that falls on the
ground.
10. Subdivision plat:
The property was part of the town plat of the original town of Fort Collins, and therefore
is not required to re -plat. We are dedicating necessary easement through separate
document.

(i) A development schedule indicating the approximate date when construction of the
project, or stages of the same, can be expected to begin and be completed, including
the proposed phasing of construction of public improvements and recreational and
common space areas.
Cherry St. Station hopes to have reached the development approval stage during the
spring of 2005. By that point, construction drawings and related work will be nearly
completed and submittal for and attainment of a building permit should happen late in
the spring or early in the summer of 2005. Building construction is expected to
commence shortly after receiving a building permit and last into the fall of 2005.
(k) Any special wildlife, natural habitats and features, ecological or environmental study
or report pursuant to Section 3.3 and 3.4 of the Land Use Code as requested by the
Director.
According to Sections 3.3 and 3.4 in the Fort Collins Land Use Code, the site for Cherry
St. Station is located within 500' of an identified feature on the Natural Habitats and
Features Inventory Map. According to the map in January of 2005, there are two
different areas of interest within the specified distance. The first is identified as "Non-
native Grassland" which is not specifically mentioned in Section 3.4.1-A.1 as a "Natural
Community or Habitat". The second is identified as "Riparian Forest." It is important to
note that both areas of interest that are mentioned above do not encompass any portion
of the development site. In fact, both areas are located on the other side of the
Burlington-Northem railroad tracks from the development site. We have met with Doug
Moore of Natural Resources on site and he has indicated that he does not feel it is
necessary to require this development application to include an "Ecological
Characterization Report" because this project is quite far away from the riparian areas
and poses little additional threat to the identified natural areas then is currently posed by
existing development in the area and the railroad.
