Section 3.5.1(C) requires buildings to either be similar in size and height, or , if larger, to be
articulated and subdivided into massing that is proportional to the mass and scale of other
structures on adjoining blocks.
There is no way to consider two eight (8) unit buildings, thirty two feet in height immediately
west of our property line similar in size and height to our residence no matter how much the
developer articulates the buildings. Putting the five (5) duplexes there would be of similar mass
of our residence and provide a much more compatible transition.
Section 3.5.1 (D) addressing privacy considerations and requires the elements of the
development plan to be arranged to maximize the opportunity for privacy by the residents and
minimize infringement on the privacy of adjoining land uses.
Moving the two (2) eight unit buildings to the west side and moving the five (5) unit buildings to
the east, with adequate landscape buffer added, will "maximize the opportunity for privacy".
Section 3.5.1 (H) Land Use Transition regarding "maximum extent feasible" as defined by section
5.1.2 "that no feasible and prudent alternative exists, and all possible efforts to comply with the
regulation or minimize potential harm or adverse impacts have been undertaken."
We believe moving the units as described above is both feasible and prudent and will minimize
the potential harm and adverse impact of the development. Consideration must be given to
higher density on the east side versus west side as proposed relating to safety of residents and
pets due to potential encounters with livestock to the east.
In regards to the scheduling of the Council Meeting: We are scheduled to take our daughter to
college on August 17t" and will be returning the 24t". We would appreciate it if you can work
around this potential conflict.

Basis for Appeal:
We do not believe the proposed development meets the requirements of code Section 3.5.1
relating to Compatibility, Privacy and Land Use Transition.
We believe the findings of the hearing officer are incorrect. We do not believe the increased set
back of seven (7) feet and adding a landscape buffer of dense stands of evergreen trees, canopy
shade trees, ornamental trees or shrubs; or deleting four (4) units from the number of units long
the east side of the property is sufficient.
It is our opinion that in the interest of compatibility, the five (5) duplexes currently on the west
side of the property should be located on the east side of the property with the two (2) eight unit
building moved to the west side.
