The Developer will line the existing three -rail PVC fence to the East of the project and along the pedestrian walkway to the south of our property with wire mesh to protect children and pets from entering the property and encountering the unpredictable behavior of our horses. Additionally, they will post appropriate signage to warn homeowners and guest of the danger in encounters with the horses, thereby attempting to reduce liability. 5. The Developer will provide extensive buffer landscaping along the East side of the project beginning at the top of the retaining wall made up of dense shrubs or hedges, numerous trees (both evergreen and deciduous) planted between our property and the buildings on the Eat side of the project. Specific shrubs, trees, and planted location will be discussed and agreed upon by all parties (see attached proposed landscape plan for details). 6. All parties acknowledge the City has a standard in place regarding temporary fencing and debris containment during the construction phase. We feel the need to meet with Developer and their representatives from the construction company to review the specifics of the provisions to make sure we minimize the impact of dust, debris and noise from the project because of proximity and the fact that we are down wind from the project. 7. An effort will be made to include a sewer tap for our future use (if feasible from an engineering standpoint) when the sewer lines are put into place. (Discussions on this item are continuing.) Box 580 Fort Collins, CO 80522 (Via Email at tshepardQfcgovcom) Re: Proposed, Spring Creek Ranch Development Project, 2010 Hull Street Dear Mr. Shepard; Once again, I find myself writing a letter regarding the Proposed Spring Creek Ranch Development Project and cannot go further without telling you howmuch Barbara and I appreciate your professionalism, patience, and guidance regarding the progress of this proposal. I believe all parties have benefited by open and frank discussions that have taken place recently most of which have been at your suggestion. Thank you. The intent of this letter is to follow-up and formally identifies those items that we have discussed and agreed upon with the Developer, Michael Mintz, the Applicant, Linda Ripley, and the engineering firm J.R. Engineering in advance of the hearing scheduled for August 3, 2005. Neither Barbara nor I will be able to attend the meeting and will ask you to forward this letter to the hearing officer. 1. The detention pond will be designed into North East Comer of the project as originally proposed based on the concession regarding the infringement on the wildlife buffer zone. 2. Move the five (5) duplex units from the West side of the project to the East and the two eight (8) unit buildings to the West side to create a more compatible transition between our property and the proposed project. 3. The Developer will locate the siphon valve for the Pleasant Valley Lake and Canal lateral ditch on our property so that we can control the flow and destination of the water from the lateral ditch. The siphon will be at the high point on our property with the drain flow diverted to the north down the lane from the back pasture to the front. It will consist of a twelve -inch line from the beginning to end as well as the drain to the north pasture. They agreed that the Homeowners Association would be responsible for the cost of maintaining a free flowing line through the development to the top of the siphon on our property. The underground portion of the pipe will go around the perimeter of the property. The Homeowners Association will be required to give us (and subsequent property owners) access to the line for cleaning and maintenance. And the Construction of the siphon will include a silt trap immediately before the underground pipe begins.
