Approval for dining areas encroaching in the ROW takes place in a separate encroachment permit process through the City's Chief Inspector. FYI - The tables shown separately from the building (the walk would be between the building and the tables) will not be permitted if alcohol is to be served. Also, if no alcohol is served in that location, only a single row of tables would be permitted in order to maintain the required clear space. The typical clear space required is 7' from the fence surrounding the dining area to the edge of walk, but when there is an obstruction on the other side (a retaining wall/fence/etc) then the distance required is 9'. The city does not allow subdrains in public rights of way and it appears that there is a proposed exterior perimeter drain. Still need the hydrologic study. Subdrains approved in e-mail dated 9-29-05 from City. Need for hydrologic study has not been determined yet as subdrain system was not a requirement of soils investigation. [6/14/05] College Avenue is a state highway, and as such, CDOT regulations must be followed for construction within that ROW and drainage onto the highway. CDOT has indicated that retaining walls and/or stairs are not permitted within the ROW. Planter boxes would be ok with a permit; closing the access on College will require a permit (free for removal) that would also cover the other work within the ROW. Please discuss drainage issues with CDOT, as well as the proposed relocation of the light pole and associated curbing to the center of College Avenue, to see what CDOT will allow.
