Compliance with Article 4 and the E Zoning District Standards: There are no applicable Land Use or Development Standards for non-residential subdivisions within the E Zoning District. The Staff Report accurately summarizes that no specific standards apply and no specific evidence was presented to contradict the statements and conclusion of the staff report concerning Article 4 or the E District Standards. 2. Compliance with Article 3 of the Land Use Code — General Development Standards The Project Development Plan complies with all applicable requirements of Article 3 particularly the plat standards of Section 3.3.1. Easements dedicated on the previous subdivision plat governing this property are not affected by this replat. No evidence was presented to contradict the statements and conclusion of the staff report concerning compliance or to other refute the compliance with Article 3. SUMMARY OF CONCLUSIONS A. The Fox Meadows Business Park Replat No. 3, Replat is subject to administrative review and the requirements of the Land Use Code (LUC). B. The Fox Meadows Business Park Replat No. 3, Replat, satisfies the development standards of the E zoning district. C. It was first master planned in 1988 as the 15.88 acre Fox Meadows Business Park. One of the anticipated land uses on the 1988 Master Plan was "child care center". On April 21, 2005, the Planning and Zoning Board approved the request for a Modification of Standard to Section 4.44 (D)(2) to allow 100% secondary uses limited to health and membership clubs, indoor limited recreation establishments and child care centers and their accessory uses. On February 6, 2006, the Board approved an amended Modification of Standard to allow 100% secondary uses limited to a convenience shopping center but with no fuel facilities or vehicle repair facilities. On June 15, 2006, the Board approved a Project Development Plan for a Convenience Shopping Center containing 27,027 square feet in a single, multi - tenant building on the 4.29 acre parcel. The re -configuration of the site plan, landscape plan and architectural elevations are being reviewed concurrently with this replat as part of the Final Plan for the P.D.P. PUBLIC HEARING The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the hearing at approximately 4:40 p.m. on May 9, 2007 in Conference Room A at 281 North College Avenue, Fort Collins, Colorado. HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE: The Hearing Officer accepted during the hearing the following evidence: (1) Planning Department Staff Report; (2) application, plans, maps and other supporting documents submitted by the applicant and the applicant's representatives to the City of Fort Collins; (3) a sign up sheet of persons attending the hearing; and (4) a tape recording of testimony provided during the hearing. The LUC, the City's Comprehensive Plan (City Plan), and the formally promulgated policies of the City are all considered part of the evidence considered by the Hearing Officer. College Avenue Fort Collins, CO 80525 Cameron Gloss Current Planning Director This is a request to replat Fox Meadows Business Park (Tract B), to be titled Fox Meadows Business Park Number Three, for the purpose of creating two separate lots to accommodate a new tenant arrangement. The applicant is requesting approval to amend the approved plan to accommodate an early childhood learning center, with after -school child care, along with a smaller, two- story commercial building. The early childhood learning center would be the Primrose School and contain 10,500 square feet on one story. The revised commercial building would contain 12,000 square feet. The site is 4.29 acres in size and located on the east side of Timberline Road, south of Bighorn Drive.
