SUBJECT: Waterdale Development and Interchange Business Park Annexations
Members of the Engineering and Planning development review staff have reviewed the annexation
requests for the Waterdale Development and the Interchange Business Park. We are not opposed to the
annexation. However, we would like to emphasize to the City that the developers of both of these sites
have entered into fairly complex Development Agreements with the County. As part of these
Development Agreements, the developers have made a variety of commitments to contribute to the
improvements to portions of the SH 14 corridor and to the I-25/SH 14 interchange. The improvements
referenced in the agreements are based on the "I-25/SH 14 Interchange Feasibility Study" prepared by
Felsburg, Holt & Ullevig, which examined the traffic impacts from developments in this area and
specifically recommended improvements to mitigate such impacts. It is my understanding that the City is
familiar with the study since they were a participant.
Given the complex nature of the agreements, the County would like to coordinate a meeting with the City
of Fort Collins in an effort to clarify the language in the development agreements and to discuss the
transition of the agreements from the County to the City. I have attached both development agreements
for the City's information. Section 10 and Section 14 of the Waterdale Special Review agreement and
Appendix E of the Interchange Business Park agreement are some of the main sections that discuss the
commitments to contribute to the road and intersection improvements.
