Re: Mulberry- East Frontage Road Annexation (Imago Property)
Emergency Access
Kevin:
Thank you for taking the time to meet with me yesterday morning to confirm the method
for an emergency access connection between the above -referenced property, pending
annexation to the City, and the Waterdale property, currently being developed in the
Larimer County. The following is what I understand we have agreed to as being
acceptable to PFA:
1. The two points of access to the Imago Property are the access road south into
Waterdale from Mulberry Street and Carriage Parkway south into the Clydesdale
development from Mulberry Street (Exhibit A).
2. Primary access shall be Carriage Parkway. The Waterdale access shall lead to a
temporary, emergency access fire lane at the end of Sunchase Drive, available for
use by authorized, emergency personnel only in the event of an emergency.
3. This temporary, emergency access fire lane shall be the east 20 feet of pad No. 39
in Waterdale, paved in asphalt, with bollards on both the Waterdale and Imago
sides at the street intersections to denote a fire lane (Exhibit B).
4. The fire lane shall be passable via a remote controlled gate to be located on the
Imago Property and clearly visible from where the fire lane intersects streets in
the Waterdale and Imago properties. (I understand that Ron Gonzolas with PFA
has drawings of and design specifications for such a gate.)
5. The fire lane shall be established through the granting of a temporary, emergency
access easement to the City of Fort Collins to be revocable upon the completion
of a permanent, secondary point of access sometime in the future.
These points of agreement are limited to the method of accessing the Imago Property, and
other public safety considerations relating to site design and construction on the Imago
property are yet to be addressed. Attorney Roger Clark, representing Waterdale developer
Paul Gallenstein, will be preparing a temporary, emergency access easement agreement
based in part upon these points. That easement is subject to City approval.
