Upon approval in the County, the developer entered into an Annexation Agreement that allows the City to annex the parcel upon contiguity being established. Contiguity will be established with the annexation of State Highway 14 - East Frontage Road Annexation which is being considered for Second Reading on November 15, 2005. The City of Fort Collins and Paul Gallenstein, developer of Waterdale Subdivision in Larimer County, have agreed to delay annexation for a period of three years in exchange for Paul Gallenstein re -issuing an updated Power of Attorney that delegates to the City Clerk the ability to annex the subject parcel. This re- issuing of a Power of Attorney is being processed and reviewed by Paul Eckman of the City Attorneys Office. In addition to the renewed Power of Attorney, Gallenstein has agreed to grant to the City an Emergency Access Easement that will allow a future second point of access from Waterdale into the Sate Highway 14 - East Frontage Road parcel. This Easement has been reviewed and found acceptable by Poudre Fire Authority.
