During that call Mr. Clark and I learned from you that the temporary emergency access easement connecting the Waterdale and Annexation properties, and successfully negotiated between City staff (Ted Shepard, Ron Gonzolas, yourself), Mr. Gallenstein and me, would not be valid without City Council approval. You indicated that the easement would be scheduled as a consent item on the Council's November 15 agenda, along with the Second Reading of the Annexation. I agree with your assessment that it would seem implausible that the Council would delay or deny this innocuous easement. Nonetheless, please know that my proceeding with this annexation is contingent upon the City's full approval of this easement now that Mr. Gallenstein and I have come to agreement. In the event that Council action on this easement is postponed, I desire that action on the Annexation be postponed. similarly; in the event this easement is denied, the Annexation is to be withdrawn.
