Considering all the issues with the construction of the water quality features, tree placements, and long term maintenance; payment in lieu of building them is a win for both the City and developer. The cost break down seems reasonable. In the spirit of cost sharing we feel that waiving the short fall on water quality capture volume and rounding the payment in lieu of to $40,000 from the estimated $48,706 is a win for both parties. The City will be able to use the funds to provide more water quality treatment in a larger facility and yet it solves a lot of site issues for development of the property. As to how and when the payment(s) are made will still need to be worked out. There are quite a few options, one of which we discussed was calculating the percentage of water quality capture volume in each phase and assigning a prorated payment per phase. I know you need to pass this on for a final decision on the part of the developer. Let me know if there are any questions. I'm sure we will be discussing this in more detail during the drafting of the Development Agreement if not before. Jim Sell Design has calculated that the water quality capture volume defined in the documents totals 4300 cu. ft. The revisions we discussed (deleting all basins in the right of way and over the outfall structure but keeping the "swale") eliminates 3700 feet of this total volume or approximately 86%. With a total cost of $56,635 the resulting prorated cost would be $48,706. Let me know if you need any more information to discuss the payment in lieu option for the water quality component. In the past we've talked about some sort of sharing of potential savings from from this effort. Even though our most recent discussion seemed to remove that option from the table we still hold out some hope that this approach could yield some shared benefit.
