Issues
Sidewalk construction — Per Section 24-95 of the City Code Development or
Redevelopment is responsible for doing the adjacent street improvements prior to by or
as specified in the development agreement. Change of use is considered redevelopment.
• Non existent walk
• Walk not meeting ada widths
• Walk detached but narrower than standards (meeting ada widths)
• Walk attached but narrower than standards (meeting ada widths)
Dedication of Ri is -of -way and adjacent easement
• Dedication of row to meet current street standard widths - more of a
concern or issue with arterial or collector roadways where this could be
dedication of 20 feet or more.
Parking lot setbacks — Boarding houses need to provide parking based on the number of
beds. In many cases this is going to mean that the whole front yard is parking.
Local streets and Collector streets — concerns
• Head in parking creating one massive curb cut — what should the max curb
cut driveway width be?
• Use of the sidewalk as a parking space - should some sort of barrier or
landscaping be required between the sidewalk and diagonal or angled
parking stalls/area.
• Non head in (driveway type) parking stalls will not meet parking setback
requirements of LCUASS. Allow, but require a variance request from
standards by licensed eng? For Collector streets — higher volumes on these
streets, does this create a safety concern for cars backing out onto the
street?
Arterial streets — concerns
• Where having to back out onto the street is not as much of a concern on the
local and probably collector streets having to back out onto the arterial to
get off of the property can create some safety issues. Most properties are
proposing using the entire front yard for parking. This type of layout does
not meet parking setback requirements in LCUASS — the setback is in
place to allow the backing of vehicles and maneuvering to occur on the
private property and not impact the public street. Is having to back out
onto the arterials an acceptable daily movement? Require a variance to
reduce the parking setback?

2006. So does the change in the boarding house parking and 350/sf
requirement change at that time? In the meeting today it was mention
Nov. 25 this year. I should have asked in the meeting.

One other thing Jim. We need to know the existing width of the
sidewalk on all of the properties you brought in and whether or not it
is attached or not.

Jim,
If Council passes the occupancy regulations on November 15, the
ordinances regarding boarding house parking, separation requirements
and
sq.ft. per boarder will take effect 10 days later, on November 25th.
You will have to have an application in to my office before the
effective date in order to be subject to the current standards.

Who do I talk to about the parking set back requirement?

street classification.

I am not certain what you mean by a curb there is one section of concrete
52" wide and then there is asphalt.

52" total (4' 6") - is that INCLUDING the curb? If so, the actual
sidewalk width is 4' as you can't include the curb in the total sidewalk
width.
Attached means that the sidewalk and curb are together... next to the
street. Detached sidewalks are separated from the street by a parkway.
The section you are speaking of is an automatic requirement when
additions of 25% or more are proposed. Our street standard and Land Use
Code says that a change of use automatically triggers the requirement to
bring your site up to standard regardless of the amount of improvements
proposed. We are waiting for an interpretation from the city attorney
as to which code is appropriate. He is on vacation this week and will
be back on the 11 th.
There is another section of the Land Use Code just after the one you
are speaking of that says no parking lots are allowed in front yards,
only side and rear yards. We will be discussing that section of the
code as well and your planner will get back to you on that as soon as
possible.

The existing concrete in front of each property is 52 in wide in all
cases.
It appears to be a single section of concrete. I do not understand what
you
mean by attached?
I would like to know if you do not think the 25% rule specifically note
in
the zoning definition for this zoning would not apply? I am not
proposing
any increase in area at this time.
