One other thing Jim. We need to know the existing width of the sidewalk on all of the properties you brought in and whether or not it is attached or not. Thanks, Susan >>> Shelby Sommer 11/1/2005 9:58:40 AM >>> Jim, If Council passes the occupancy regulations on November 15, the ordinances regarding boarding house parking, separation requirements and sq.ft. per boarder will take effect 10 days later, on November 25th. You will have to have an application in to my office before the effective date in order to be subject to the current standards. Questions about parking setbacks can be addressed by the Engineering Department. Dan DeLaughter will be your point of contact for these boarding houses. You may contact Dan at 331-6605 or ddelaughter(@fcgov.com. Feel free to call/email if you have any other questions. One last thing ... when Steve Olt and I have your comment letters and checklists ready, do you prefer to have them emailed, regular mailed, or faxed? Please give me your mailing address/fax number if that's what you prefer. Who do I talk to about the parking set back requirement? It was my understanding that this ordinance would go into affect Jan 1, 2006. So does the change in the boarding house parking and 350/sf Steve Olt - RE: Boarding house process r 1' From: Peter Barnes To: Susan Joy Date: 11/02/2005 12:03:42 PM Subject: RE: Boarding house process The wording in (b) is for developments with NEW parking lots. If they use existing parking areas, then they can remain in their present location. >>> Susan Joy 11/02/2005 12:01:16 PM >>> Thanks Peter. Also, what is your take on paragraph b, parking lots: Development Plans shall be arranged so that Parking lots or other vehicle use areas are located in side or rear yards, not in front yards? I looked up the definition of parking lots in the Land Use Code and it is defined as "shall mean and off- street parking area or vehicular use area. That pretty much says that any boarding house would have to move all parking areas to the side or rear lot so that they are not paving the entire front yard for parking. What do you think? >>> Peter Barnes 11/2/2005 11:13:51 AM >>> Susan, while you're waiting for Paul to return, here's my take on it with regards to the LUC. Section 3.1.2 of the LUC states that when there's a conflict between a standard in Artilce 3 and Article 4, the standard in Article 4 always prevails. So I guess Paul will have to give some advice with regards to the street standards versus Artilce 4. >>> Susan Joy 11/02/2005 10:48:10 AM >>> 52" total (4' 6") - is that INCLUDING the curb? If so, the actual sidewalk width is 4' as you can't include the curb in the total sidewalk width. Attached means that the sidewalk and curb are together... next to the street. Detached sidewalks are separated from the street by a parkway. The section you are speaking of is an automatic requirement when additions of 25% or more are proposed. Our street standard and Land Use Code says that a change of use automatically triggers the requirement to bring your site up to standard regardless of the amount of improvements proposed. We are waiting for an interpretation from the city attorney as to which code is appropriate. He is on vacation this week and will be back on the 11th. There is another section of the Land Use Code just after the one you are speaking of that says no parking lots are allowed in front yards, only side and rear yards. We will be discussing that section of the code as well and your planner will get back to you on that as soon as possible. Susan »> 11/2/2005 10:25:48 AM >>> The existing concrete in front of each property is 52 in wide in all cases. It appears to be a single section of concrete. I do not understand what you mean by attached? I would like to know if you do not think the 25% rule specifically note in the zoning definition for this zoning would not apply? I am not proposing any increase in area at this time.
