Therefore, this standard has been met. B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications The plat indicates that utility easements will continue to be provided as needed to serve the lot. No additional right-of-way is needed as part of the replat. SUMMARY OF CONCLUSIONS A. The Timberline Center, Lot 14, Replat is subject to administrative review and the requirements of the Land Use Code (LUC). B. The Timberline Center, Lot 14, Replat satisfies the development standards of the I zoning district. C. The Timberline Center, Lot 14, Replat complies with all applicable General Development Standards, including the Plat Standards, contained in Article 3 of the Land Use Code. DECISION The Timberline Center, Lot 14, Replat, #41-05C, is hereby approved by the Hearing Officer. Site Context/Background Information The surrounding zoning and land uses are as follows: N: T; Existing Outside Storage and Miscellaneous Light Industrial S: E; Police Services Building (under construction) E: L-M-N; Vacant (Side Hill Second Filing) W: R-L; Parkwood East Subdivision W: M-M-N; Parkwood East Apartments The property was first considered for annexation, as part of the 435-acre Timberline Annexation, in 1992. At that time, the request was a voluntary annexation. While Staff and the Planning and Zoning Board recommended approval, City Council denied the request. In 1997, Timberline Annexation was approved and placed into T, Transition zone district. A request to rezone 16.13 acres from Transition to Industrial was approved in 2005. On December 8, 2005, Timberline Center was approved for a mixed -use project located in the Industrial zone. Specifically approved uses include a convenience shopping center, general office, bank, retail stores with vehicle servicing, vehicle minor repair, standard restaurant, fast food restaurant and enclosed mini - storage. A minor amendment to the Timberline Center PDP has been approved consistent with the proposed replat. 2. Compliance with Article 4 and the I -Industrial Zoning District Standards: There are no land use or development standards within Article Four of the Land Use Code applicable to this plat request. 3. Compliance with Article 3 of the Land Use Code — General Development Standards A. PUBLIC HEARING The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the hearing at approximately 4:20 p.m. on May 31, 2007 in Conference Room A, 281 N. College Avenue, Fort Collins, Colorado. HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE: The Hearing Officer accepted during the hearing the following evidence: (1) Planning Department Staff Report; (2) application, plans, maps and other supporting documents submitted by the applicant and the applicant's representatives to the City of Fort Collins; and (3) a tape recording of the public hearing. The LUC, the City's Comprehensive Plan (City Plan), and the formally promulgated policies of the City are all considered part of the evidence considered by the Hearing Officer.
