Sign District. A map amendment would be necessary to place this property on the

The property is 3.04 acres in size and is located on the south side of East Mulberry Street
and west of Timberline Road. The proposed zoning for this annexation is C — Commercial.
Analysis:
The recommended zoning for this annexation is the C - Commercial Zoning District. There
are numerous uses permitted in this District, subject to either administrative review or
review by the Planning and Zoning Board. The City's adopted Structure Plan, a part of the
Comprehensive Plan, suggests that a Commercial Corridor District designation is
appropriate in this location.
Staff is recommending that this property not be included in the Residential Neighborhood
Sign District, which was established for the purpose of regulating signs for non-residential
uses in certain geographical areas of the City which may be particularly affected by such
signs because of their predominantly residential use and character. A map amendment
would be necessary to place this property on the Residential Neighborhood Sign District
Map.
Findings:
1. The annexation of this area is consistent with the policies and agreements between
Larimer County and the City of Fort Collins contained in the Intergovernmental
Agreements.
2. The area meets the eligibility requirements included in State law to qualify for a
voluntary annexation to the City of Fort Collins.
3. On June 1, 2004, the City Council considered a resolution determining that the
proposed annexation process for this property by establishing the date, time, and
place when a public hearing will be held regarding the readings of the Ordinances
annexing and zoning the area. Public hearing and first reading of the Ordinances
annexing and zoning the property will be considered by the City Council on April 6,
2004.
4. The C - Commercial Zoning District is appropriate for this site based on adjacent
zoning, existing land uses, and the City's adopted Structure Plan.

Background:
This is a voluntary annexation. The area to be annexed is unincorporated municipally -
owned land.
In accordance with CRS 31-12-106 Annexation of Enclaves, Partially Surrounded Land,
and Municipally Owned Land, when the municipality is the sole owner of the area
that it desires to annex, which area is eligible for annexation as set out in CRS 31-
12-104(1)(a) and CRS 31-12-105, the governing body may by ordinance annex said
area to the municipality without complying with:
• CRS 31-12-108 Setting Hearing Date - Notice Given; or
• CRS 31-12-109 Hearing.
The annexing ordinance shall state that the area proposed to be annexed is owned by
the annexing municipality and is not solely a public street or right-of-way.
The property is located within the Fort Collins Growth Management Area (GMA). According
to policies and agreements between the City of Fort Collins and Larimer County contained
in the Intergovernmental Agreements, the Citywill agree to consider annexation of property
in the GMA when the property is eligible for annexation according to State Law. Pursuant
to the Intergovernmental Agreements the following sections are relevant to the Mulberry
East 15 Annexation and Zoning:
Section 1 - GROWTH MANAGEMENT AREA
8. - Annexations
8(A) It is the City's intent to annex properties within the GMA as
expeditiously as possible.
8(C) The City agrees to annex all County Road rights -of -way,
easements, etc., adjacent to a voluntary annexation.
The property is located within the Fort Collins Urban Growth Area. According to policies
and agreements between the City of Fort Collins and Larimer County contained in the
Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to
consider annexation of property in the UGA when the property is eligible for annexation
according to State law. This property gains the required 1/6 contiguity to existing City limits
from common boundaries with the Riverbend Annexation (July, 1980) to the south and
west and the Riverbend Third Annexation (August, 2000) to the south.

PROJECT DESCRIPTION:
This is a request to annex and zone 3.04 acres located on the south side of East Mulberry
Street and west of Timberline Road. It is currently zoned C — Commercial in Larimer
County. The recommended zoning in the City of Fort Collins is C — Commercial.
RECOMMENDATION:
Staff recommends approval of the annexation and that the property be placed in the C -
Commercial Zoning District.

Sign District. A map amendment would be necessary should the Planning and Zoning
Board recommend that this property be placed on the Residential Neighborhood Sign
District Map.
EXECUTIVE SUMMARY:
This is a request to annex and zone 3.04 acres located on the south side of East Mulberry
Street and west of Timberline Road. The proposed zoning for this annexation is C —
Commercial.
The property is developed. It includes a storm water drainageway and streets. It is in the
FA - Farming Zoning District in Larimer County. This is a voluntary annexation of City -
owned property.
Staff is recommending that the property be placed in the C - Commercial Zoning District,
which is in conformance with the City's Structure Plan, and that it not be included in the
Residential Neighborhood Sign District.
