3. The Heffington Farm Subdivision Project Development Plan (PDP) contains
existing permitted uses, and meets the requirements in the LMN - Low Density
Mixed -Use Neighborhood District.
RECOMMENDATION:
Staff recommends approval of the Heffington Farm Subdivision, Project Development
Plan - #2-06.

A. The subdivision plat is in compliance with Section 3.3.1(A) General
Provisions in that:
1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in
writing on the plat and signed by the City Clerk.
2) No building permit or certificate of occupancy shall be issued for
construction of any new principal building or no act which changes the
use of any building shall be permitted until the subdivision plat is filed
and recorded in the City of Fort Collins.
B. The subdivision plat is in compliance with Section 3.3.1(B) Lots in that:
1) The new lot will have direct vehicular access to a public street (West
Drake Road).
2) The layout of the lot preserves the existing street system,
neighborhood development and trail system.
C. The subdivision plat is in compliance with Section 3.3.1(C) Public Sites,
Reservations and Dedications in that:
1) The applicant will dedicate right -of way for public streets, drainage
easements and utility easements as needed to serve the area being
platted.
2) The applicant will reserve sites for flood control and trail easements in
the area being platted.
4. Article 4 — District Standards:
The Heffington Farm Subdivision Project Development Plan (PDP) complies with the
applicable requirements within Division 4.4 — Low Density Mixed -Use Neighborhood
District in Article 4 — Districts of the Land Use Code (LUC).
FINDINGS OF FACT/CONCLUSIONS
1. The Heffington Farm Subdivision Project Development Plan (PDP) meets the
procedural requirements located in Division 2.1 - General Procedural
Requirements, and Section 2.4 - Project Development Plan in Article 2 -
Administration of the Land Use Code (LUC).
2. The Heffington Farm Subdivision Project Development Plan (PDP) meets the
plat standards located in Section 3.3.1 - Plat Standards of Article 3 - General
Development Standards of the Land Use Code (LUC).

1. Background:
The surrounding zoning and land uses are as follows:

Project Development Plan
The purpose of the Heffington Farm Subdivision, Project Development Plan (PDP) is to
create one legal lot from three adjacent parcels of land. The subdivision plat will
consolidate the parcels at 1815 W. Drake Road, 1821 W. Drake Road and the driveway
parcel which provides access to the other two parcels from Drake Road. Currently,
there is a wastewater tap that is shared between buildings on the 1815 and 1821
properties, and this property may not be sold separately in the future because of the
combined tap. This replat will alleviate this potential problem from the combined tap,
and will provide access via the existing driveway parcel. With this plat, an additional 7.5
feet of right-of-way and a 15 foot utility easement will be dedicated along Drake Road,
and a 9 foot utility easement will be dedicated along Hull Street. The property is zoned
LMN, Low Density Mixed -Use Neighborhood District, and this replat is permitted in this
zone district, subject to Administrative Review. There are no plans to develop this
property at this time, and all existing uses are permitted in the LMN District.
2. Article 2 - Administration:
The Heffington Farm Subdivision, PDP complies with the applicable requirements of the
Land Use Code (LUC), specifically the procedural requirements located in Division 2.1 -
General Procedural Requirements, Division 2.2 - Common Development Review
Procedures for Development Applications, and Section 2.4 - Project Development Plan
in Article 2 - Administration.
3. Article 3 - General Development Standards:
The Heffington Farm Subdivision Project Development Plan (PDP) complies with the
applicable requirements of the Land Use Code (LUC), specifically the plat requirements
located in Section 3.3.1 - Plat Standards in Article 3 - General Development
Standards.

PROJECT DESCRIPTION:
This is a request to consolidate three separate, contiguous parcels at 1821 W. Drake
Road and 1815 W. Drake Road, and the driveway providing access to these properties
from Drake Road, into one parcel. No additional development is proposed with this
request. All three properties are within the City of Fort Collins and zoned LMN, Low
Density Mixed -Use Neighborhood.
RECOMMENDATION: Approval

The Heffington Farm Subdivision PDP development proposal complies with applicable
requirements of the Land Use Code (LUC), more specifically:
• the process and procedures located in Division 2.2 - Common
