Yes this is a hearing before the Council and not an appeal (where there are different rules regarding parties that can testify). 4. Why weren't we (neighbors) notified about the rezoning issue? A mail notice outlining the rezoning request and providing City contact information was sent to all property owners within 500 feet of the property subject to the rezoning. A sign is also posted on the property giving the general public notice of the proposal. In addition, there was a Neighborhood Meeting sponsored by the City of Fort Collins held on February 27th. 5. Is a rezoning request that goes to the Council appealable (if they don't agree with the Council's decision)? The City Council is the decision maker on the rezoning request; therefore, there is no public appeal to the decision. Aggrieved parties would need to seek court action to modify the Council's action. 6. Is there a second reading to Council's decision about the rezoning matter? Yes. The second reading of the Harmony and Shields rezoning ordinance has been tentatively scheduled for May 2nd. 7. Does this area have any potential to be designated/acquired as a Natural Area? No. The City's Natural Resources Department has evaluated the site and found that no significant wildlife habitat or species on the site that would warrant Natural Area purchase. How can citizens petition for it to be considered and preserved as a Natural Area/Open Space? A petition could be submitted to the Land Conservation and Stewardship Board (a City board) for its review and potential recommendation to the City Council. 8. To whom/what e-mail address can we send our comments and provide input on this matter to the City? The Project Manager for the Rezoning application is the City's Current Planning Director, Cameron Gloss. Cameron Gloss - 0306 Rezoning Questions.doc Page 1 j The following is a response to the questions posed at Councilman Kastein's District Meeting on March 6, 2006 regarding the proposed Harmony and Shields Rezoning request. Note that 11 of the participants in the District Meeting also attended the City -sponsored neighborhood meeting where many of the same issues were discussed. 1. What is the process for the rezoning —who can/had submitted the request, what is the request, what are the steps of the City process (staff, P&Z, Council)? Rezoning applications can be submitted two times per year except in the cases of rezoning associated with redevelopment, which can be submitted at any time. A rezoning may be proposed by the City Council, the Planning and Zoning Board, the Director or the owners of the property to be rezoned. In this case, an authorized representative of the property owner has submitted a petition to rezone a portion of a 58-acre parcel located north of Harmony Road and west of Shields Street. The majority of the property is presently zoned with a mix of MMN-Medium Density Mixed Use Neighborhood and approximately 18 acres designated "NC -Neighborhood Commercial". The rezone application would "flip" the zoning designations, such that the NC portion of the site presently would move approximately 500 feet to the south, and the area to the north previously NC, would then be rezoned to MMN-Medium Density Mixed Use Neighborhood. The following steps in the review process remain: Step 1: Planning & Zoning Public Hearing- March 16, 2006 6:00 pm City Council Chambers at 300 LaPorte Avenue. Planning & Zoning Board will take public testimony at the hearing and prepare a recommendation to the City Council. Step 2: City Council 1st Reading of the Rezoning Ordinance- April 18, 2006 at 6:00 pm City Council Chambers. City Council will take public testimony and decide whether to approve or deny the applicant's rezoning request. Step 3: City Council 2nd Reading of the Rezoning Ordinance -May 2, 2006 at 6:00 pm City Council Chambers. 2. What is the boundary within which one is considered a "party in interest"? All property owners within 500 feet of the property subject to the rezoning are technically considered "parties -in -interest". The same is true for all individuals that testify at the Planning and Zoning Board Hearing, whether or not they live within 500 feet of the property. 3. Who can speak at the P&ZHearing? Any individual or individual authorized to speak on behalf of a group. At the Council Hearing? Any individual or individual authorized to speak on behalf of a group.
