Our subdivision has nearly three miles of trail easements interconnecting all lots for walking, jogging and horseback riding. The locations of the trails are shown in black on the enclosed map of Applewood Estates. Our concerns center on two trails located along the north and west boundaries of Lot 29. This lot has been purchased by the developer, who has submitted plans to dig a detention pond on the north half of the lot to control drainage off the Orchard. The pond is shown on the Detention Pond Planting detail of the Landscape Plan. While we would prefer that the pond be located within the Orchard subdivision, our objection is to the location of drainage swales within our trails. The trails affected are outlined on the enclosed detail of the detention pond. As can be seen, one swale, which appears more like a ditch, runs along the trail on the north boundary of the lot. This trail is only 10' wide and will be made unusable for recreational purposes by the ditch. The other Swale, again a ditch, crosses the northerly end of the trail along the west boundary, creating a break in the trail system. When Applewood Estates was platted in 1964 the nearest development stopped at Drake. Now in 1990 the Orchard will be one of the last links in a circle of development surrounding our subdivision. As development has proceeded, our trail system has grown in utility and value to Applewood families. In fact, we recently contracted to have our irrigation system placed underground along the north boundary of the subdivision, including Lot 29, at an expense of over $17,000.00. One of the benefits of this improvement will be to make the trail system more usable. We consider any alteration of the grade of the trails to be incompatible with our trail easements and so value our system that we would oppose any alteration in court if necessary. Two other concerns appear to have already been resolved. One 0 Planning and Zoning Board March 22, 1990 Page 2 involved the type of fencing to be installed along our border with the Orchard. Our covenants require that the trail system be enclosed by 3 pole fence. Since any type of privacy fencing would detract from the spacious feeling of the area and could cause horses to shy from using the trail, we requested that 3 pole fence be mandated along this border by Orchard covenant as well. We understand that a similar covenant already governs certain other parts of Clarendon Hills development. We have been informed by the city planner that the developer has agreed to this request. A final concern involved landscaping around the detention pond. The plan shows trees planted in the trail. We have been informed by the city planner that the trees will be moved out of the trail. We have appreciated the assistance of the city planner and the cooperation of the developer in resolving our concerns and trust that the drainage plan can be altered to preserve our trail system.
