I appologise for not contacting you promptly after our design charette but I did discuss setting up a special meeting, with Steve Burns, to get people together to discuss these issues. My first reaction to your comments is that, yes, we would need to replat with some separate tracts defined. Also, the City has used alignments in the past instead of easements to dedicate appropriate areas. So, there is a way to make these things happen. This could be a challenging project from your perspective. would be ready to start scheduling a meeting with interested parties as soon as I have a signed contract from the Design/Builder. At a design meeting Tuesday, it was noted that the project was adding a new drive off of Willow that was on a lot purchased by the City. The thought was that the existing Aztlan/United Way/Park site was an existing parcel and by adding this lot, we would need to replat to merge the two properties. I have looked at the County's website and it appears that there are many properties and alleys that were never replatted with the construction of the two existing buildings. The attached drawing shows the City's parcel map, a background of the existing and proposed improvements for Aztlan, and the heavy line is the boundary of a parcel called the "Old Fort Site" or the "Old City Dump". You can see that a part of the existing United Way parking lot is on a lot that was not part of the "Old Dump" and actually there is parking in Pine Street Right of Way. The lot we were adding is on Willow just southeast of the proposed building site. Please note that the railroad spur is in an easement and was not transferred from City ownership. In a brief discussion with Wally Muscott, he told me that it may now be possible to not replat parcels for infill development. I am wondering if this site may fit into that scenario. I would assume that with Title Work, we could verify that all proposed improvements are on City Owned areas, and the site has received at least two building permits to date. Can we legally pull a building permit and go through the PDP FCP process without a subdivision plat? This question is critical as I am trying to scope topographic survey for the project. If we need to provide a boundary and plat, it will be very time consuming (expensive) because of the age of the area and the number of parcels. We would need to do the boundary work at the same time as the topo to try to keep costs down as much as possible. Also, I have a question regarding the setback from Willow. We are showing the new building right up to the Willow Street Right of Way. This is similar to the existing Giddings (Bas Bleu) Building and what has been previously proposed for Jon Proutys Willow Street Lofts Project. Because of the excess Right of Way (100') does this area not require a utility easement behind the right of way? Can the buildings be set on the ROW because of the downtown nature of the area? I know I am asking a lot, but your help is greatly appreciated by everyone. I would assume that this may not be just a planning/building/engineering questions, but one that may need the City Attorneys decision. If we are required to do a plat, I need to know if there are any changes from a standard plat because of the City ownership. I know there are issues with the City dedicating easements, etc. to itself. Please let me know your thoughts and if there is anyone else I should be asking as soon as you can. Thanks.
