Addition of this use is based on the following proposed definition which has been presented to me: "Wildlife Rescue and Education Center. A facility that provides shelter services for the rescue and care of injured birds or other small wildlife with associated education and research." My understanding is that the proposed facility will include the medical care and rehabilitation of injured birds of prey for release to the wild, and the care and display of permanently nonreleasable birds of prey and other small wildlife in a park -like setting for the purpose of public education. Current permitted uses in these two zones include parks, recreation, open lands, education, and veterinary care, which are similar to the proposed use. Finally, please follow up with Codification of the New Use pursuant to 1.3.4(B). Community Planning and Environmental Services Advance Planning MEMORANDUM DATE: March 24, 2006 TO: Cameron Gloss, Director of Current Planning FROM: Gregory Byrne, Director Community Planning and Environmental RE: Addition of Permitted Use, Rocky Mountain Raptor Program The Land Use Code currently lacks a suitable land use classification for the operations of the Rocky Mountain Raptor Program, as described in their development application dated 3/8/2006. I find that a new land use, Wildlife Rescue and Education Center, is suitable for addition to the Land Use Code in conjunction with that development application. Addition of this use conforms to the c6nditions set forth in section 1.3.4 of the Land Use Codd as follows: (1) the use is appropriate in the zone district to which it is added; (2) the use conforms to the basic characteristics of the zone district and the other permitted uses in the zone district to which it is added; (3) the use does not create any more offensive noise, vibration, dust, heat, smoke, odor, glare or other objectionable influences or any more traffic hazards, traffic generation or attraction, adverse environmental impacts, adverse impacts on public or quasi -public facilities, utilities or services, adverse effect on public health, safety, morals or aesthetics, or other adverse impacts of development, than the amount normally resulting from the other permitted uses listed in the zone district to which it is added; (4) the use is compatible with the other listed permitted uses in the zone district to which it is added; (5) the use is not specifically listed by name as a prohibited use in the zone district to which it is added; (6) the use is not specifically listed as a "Permitted Use" in Article 4. (See Section 2.9 for the procedures for text amendments.) Therefore, please add this land use to the Industrial zone district and the Low Density Mixed -Use Neighborhood zone district in conjunction with the RMRP application, subject to review by the Planning and Zoning Board in each case. 281 N.
