RE: South College Avenue 38 Acres: Rezoning With Lithia Real Estate 13 Acres
Dear Steve:
As you know, Front Range Limited Partnership owns the approximately 38 acres which
abuts the south boundary of the Lithia Real Estate 13 acres (which Lithia purchased from Front
Range earlier this year), extending down to Trilby Road, except for the comer of Trilby Road and
College Avenue. Your company is representing Lithia is its request to change the zoning for its
entire 13 acres to "C" commercial and, in the course of your conversations with the City of Fort
Collins, I understand the City asked if Front Range would be willing to return its entire 38 acres
to the "C" commercial zone also.
Please consider this letter Front Range Limited Partnership's consent and request to
rezone its entire remaining 38 acre parcel south of the Lithia parcel to "C" commercial and,
further, its request that your company to act on the partnership's behalf in the rezoning process.
All correspondence, information and requests concerning the rezoning of Front Range's
parcel as described in this letter should be directed to me at the above address.

Re: Written Justification for Rezoning
per Section 2.9.4(H) of the Land
Use Code
Lithia Real Estate Inc. along with Front Range Limited Partnership,
C O L College and Trilby LLC and Southgate Church have joined in
collaboration in requesting a rezone of their respective properties to its prior
zoning classification of commercial (c). The current zoning districts on
these properties consists of 16.844 acres for neighborhood commercial
(nc) and 22.147 acres for medium density mixed use neighborhood (mmn)
totaling 38.991 gross acreage. The entire property bounded by Skyway
Drive to the north, South College Avenue to the east and Trilby Road along
the south was zoned commercial (c) prior to January 30th, 2002.
It is our understanding that the rezoning approved in 2002 was in
response to a specific development opportunity that was not realized by
Front Range Limited Partnership. Lithia Real Estate Inc. and Front Range
Limited Partnership, as the primary landholders, along with the approval of
C O L College and Trilby, LLC and the Southgate Church, are requesting
that all the above -mentioned properties be rezoned to commercial.
The Current Planning Department in the City of Fort Collins would
like to see the entire property revert to commercial (c) in order to maintain
the integrity of the overall concept for the area.
