Number: 4 Created: 12/7/2006 [12/7/06] The transition from residential to commercial is established across the street on the south side of East Swallow Road, to include MMN land use designation. Number: 5 Created: 12/7/2006 [12/7/06] Staff does not support the rezoning request for a single parcel as this can result in a spot zoning. Some existing home occupation uses are present along this street. A rezoning to MMN would diminish the integrity of the existing neighborhood more than the effect of increasing a transitional mixed -use designation for this single parcel. Department: Current Planning Issue Contact: Steve Olt Topic: Current Planning Number: 7 Created: 12/26/2006 [12/26/06] City staff finds that the applicant's justification for the rezoning request is not sufficient for staff to recommend approval of the rezoning of the property at 200 East Swallow Road. The request does really constitute a "spot zoning" in this area. The property is in the RL District, with surrounding properties to the north and east still occupied as single-family residences. The office uses to the west, across Remington Street, relate to the South College Avenue commercial corridor; and, the commercial uses to the south are separated from this property by a major arterial street. Therefore, the rezoning request will move forward to the Planning & Zoning Board and City Council without support from City staff.
