B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat will indicate proper dedication for utility easements as needed to serve
both lots. Eight (8) feet of right-of-way will be dedicated along LaPorte Avenue,
and 0.5 feet of right-of-way will be dedicated at Juniper Court. Further, a utility
easement has been dedicated by separate instrument along the east side of Lot
2 to accommodate on -site utilities.
C. Section 3.3.2 (D) - Required Improvements
A four -foot wide sidewalk will be constructed along the Juniper Court street
frontage in a design meeting the adopted engineering standards.
SUMMARY OF CONCLUSIONS
A. The 1136 LaPorte Ave. — Menning Subdivision Project Development Plan subject
to administrative review and the requirements of the Land Use Code (LUC).
B. The 1136 LaPorte Ave. — Menning Subdivision Project Development Plan
satisfies the development standards of the NCL zoning district.
C. The 1136 LaPorte Ave. — Menning Subdivision Project Development Plan
complies with all applicable General Development Standards, including the Plat
Standards, contained in Article 3 of the Land Use Code.
DECISION
The 1136 LaPorte Ave. — Menning Subdivision Project Development Plan, #25-06, is
hereby approved by the Hearing Officer without condition.
Dated this 1 st day of November 2006, per authority granted by Sections
1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
1. Site Context
The surrounding zoning and land uses are as follows:
N: NCL; existing single family residential
S: LMN; existing single family residential
E: NCL and NCM; existing single family residential
W: NCL; existing single family residential
The parcel was annexed into the City as part of the Northwest Consolidation
Annexation in 1954.
2. Compliance with Article 4 and the NCL Zoning District Standards:
The plat complies with the standards found under Article Four of the Land Use
Code. The applicant's request to replat the 14,894 square foot lot, in order to
create two lots of 7,282 square feet and 7,612 square feet, complies with the
following standards:
Section 4.6(D) and (E) — Land Use and Density Standards
The proposed lots greatly exceed the minimum 6,000 square foot lot size
required in the NCL zone district. Further, the minimum lot width of 40 feet will be
exceeded for both lots.
There was no evidence introduced at the hearing to contradict the Staff Report;
therefore, the Hearing Officer finds that the Subdivision is in conformance with
the applicable requirements found in Article 4 of the Land Use Code.
3. Compliance with Article 3 of the Land Use Code — General Development
Standards
A. Section 3.3.1 [B] — Lots
The proposed lots comply with the design standards in that each lot has
vehicular access to a public street, and the side lot lines are at substantially right
angles or radial to the street. The design of the adjacent platted streets, LaPorte
Avenue and Juniper Court, are unaffected.

PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 5:00 p.m. on October 26, 2006 in Conference Room A at 281
N. College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
and (3) a tape recording of testimony provided during the hearing. The LUC, the City's
Comprehensive Plan (City Plan), and the formally promulgated policies of the City are
all considered part of the evidence considered by the Hearing Officer. .

The Applicant has submitted a request to subdivide one existing platted lot of 14,894
square feet into two lots. Proposed Lot 1 would be 7,282 square feet and Lot 2 would be
7,612 square feet. There is one single family house existing on the property, which is
addressed as 1136 LaPorte Avenue.
