It has been determined that this development request could possibly be
placed on the agenda for the January 18, 2007 Planning & Zoning Board
public hearing. However, there are some issues and concerns with various
City departments that must be addressed before this item could go to the
Board. This could be done through another formal round of review (if re-
submitted quickly) or by working directly with the appropriate
representatives of the departments. Staff will be setting the P & Z Board
agenda on December 20, 2006.
Be sure and return all red -lined plans when you re -submit.

detaining for on -site runoff and not off -site runoff from the north and west.
In the discussion, describe where the other lots that are undeveloped will
detain and outfall. This is needed because this proposal is changing the
existing design for all 4 of these lots. Please discuss how the interim
(existing) undeveloped off -site flows will drain. This site may need to route
these off -site flows through the site. Please remove discussion with City
Staff in the text and only include the explanations. Additional information
was added to the text of the report.

[ 11 / 21 / 06] The .06 cfs release rate for the detention pond is impractical
(being less than the water quality release rate) and also will probably have
clogging problems. It is suggested that you request a variance to allow
basin F to release undetained and keep the detention pond release rate
equal to the site release rate of .36 cfs. This will allow for a practical release
and still provide adequate detention and still improve the situation for the
regional downstream drainage system. The release rate was revised.

[11/28/06] A request for a modification of the standard set forth in Section
3.5.3 of the Land Use Code, regarding the required "build -to" lines, must be
submitted for review by staff and the Planning and Zoning Board. The
Housing Services Day Center building does not satisfy this standard as it
relates to Blue Spruce Drive. It is 17' from the street right-of-way.
* Also, Neither the Housing Services Day Center building nor the future
building on Lot 2 satisfy the standard set forth in Section 4.28(E)(2)(b)
of the Land Use Code. Their setbacks from Conifer Street must be no
more than 30' from the street right-of-way for at least 30% of the
building face and they are shown as being 45' to 50' from the right-of-
way. Therefore, a request for a modification of this standard must be
submitted for review by staff and the Planning and Zoning Board.
* Please reference Section 2.8.2(H) of the Land Use Code for the criteria to
use in the requests for modifications of the standards.
Steve Olt confirmed that we do not have to adhere to the regulations of Land
Use Code #3.5.3 because 4.28 takes presidence. However, I have reviewed
4.28 again and I show that we are meeting all of the regulations of this section.
