f. The FDP complies with Section 3.5.2, Residential Building Standards, because it
provides a walkway along the east property line, abutting the alley, and includes a front
entrance featuring a large porch on the south elevation and walkway connecting to the
existing sidewalk along West Laurel Street.
g. The FDP complies with Section 3.6, Transportation and Circulation, because the
FDP is not expected to generate enough traffic to warrant a transportation impact study.
h. The FDP complies with Section 3.8.30, Multi -family Dwelling Development
Standards, because: the FDP is bounded on the north and west by the existing residential
home converted to office use for Colorado State University and on the east by the alley
and Rainbow Cafe; the entrance is clearly distinguishable from West Laurel Street; and the
length of the east and west elevations are mitigated by changes in materials and
articulation.
3. The FDP complies with the applicable standards contained in Article 4 of the Code
for the C-C zone district.
a. The FDP complies with Section 4.18(B)(2), Permitted Uses, because multi -family
residential buildings of less than 50 units and 75 bedrooms are permitted uses in the C-C
zone district, subject to Administrative Review.
b. The FDP complies with Section 4.18(D)(2), Land Use Standards, because the FDP
appropriately contributes to the Mason Street corridor's mix of commercial uses, the
commercial uses moving east along Laurel Street, and the institutional uses (Colorado
State University) to the south.
C. The FDP complies with Section 4.18(E), Development Standards, because the FDP
is oriented to West Laurel Street, in close proximity to the MAX Bus Rapid Transit, and
the building is approximately 29 feet tall, meeting the minimum requirement of 20 feet.
DECISION
Based on the foregoing findings, the Hearing Officer hereby enters the following rulings:
The PDP/FP is approved as submitted.

FINDINGS
I. Evidence presented to the Hearing Officer established the fact that, though there
was an issue with the notice for the original hearing on October 29, 2013, that issue was corrected
for the continued hearing on November 13, 2013 so that interested persons would receive the
corrected notice, and therefore, the hearing was properly posted, legal notices mailed and notice
published.
2. The FDP complies with the General Development Standards contained in Article 3
of the Code.
a. The FDP complies with Section 3.2.1, Landscaping and Tree Protection, because:
the FDP provides full tree stocking with the inclusion of honey locust, crabapple and
serviceberry trees in the landscaped areas around the building; the existing American Elm
street tree will be protected, thus meeting the street tree requirement; no one species of the
proposed 15 trees exceeds 50% of the total trees, because the most of any one species is
the serviceberry, of which 4 trees are proposed; the overall water budget of 6.9 gallons per
square feet is far less than the 15 gallons per square feet allowed; the FDP provides
intermittent landscaped areas featuring evergreen and ornamental trees along the east
elevation; and the City Forester has inventoried the existing trees and a tree mitigation plan
has been incorporated in the landscape plan, with 4 existing trees to be removed and the
loss of those 4 trees mitigated.
b. The FDP complies with Section 3.2.2, Access, Circulation and Parking, because:
the site will take access off the alley via West Myrtle Street and/or West Laurel Street; 8
off-street parking spaces are provided in garages located on the ground level of the
building; projects within the TOD are not subject to minimum parking requirements; for
multi -family residential projects, a minimum of 1 bicycle parking space per bedroom with
a minimum of 60% of those spaces to be enclosed and 40% of those spaces in fixed racks
is required, and the FDP provides 12 enclosed parking spaces and 2 exterior fixed bicycle
racks.
C. The FDP complies with Section 3.2.4, Site Lighting, because the exterior building -
mounted light fixtures will be down directional with sharp cutoff luminaries.
d. The FDP complies with Section 3.4.7, Historic and Cultural Resources, because the
existing one-story residence at 281 West Laurel Street determined not to be individually
eligible for Local Landmark designation, but the abutting property to the west at 222 West
Laurel Street is individually eligible for local landmark designation, and the FDP meets the
applicable standards in Section 3.4.7(F) by incorporating Craftsman elements such as the
large overhanging eaves and the shed roof on the porch.
e. The FDP complies with Section 3.5.1, Building and Project Compatibility, because
the building mass is mitigated by projections and recesses and the FDP includes materials

PROJECT DESCRIPTION: This is a request for approval of a consolidated Project Development
Plan and Final Plan (FDP) to demolish an existing single family residence and construct a new 6
unit, 12 bedroom multi -family building at 218 West Laurel Street. The project will provide 8
parking spaces inside garages on the ground level of the building. The property is 0.15 acres.
SUMMARY OF DECISION: Approved
ZONE DISTRICT: Community Commercial (C-C) with Transit Oriented
Development (TOD) Overlay
HEARING: The Hearing Officer opened the hearing at approximately 5:30 p.m. on October 29,
2013, in Conference Room A, 281 North College Avenue, Fort Collins, Colorado, and because of
an issue with the notice, the hearing was continued to November 13, 2013. The hearing was re-
opened at approximately 6:10 p.m. on November 13, 2013 and concluded that evening.
EVIDENCE: During the hearing, the Hearing Officer accepted the following' evidence:
(1) Planning Department Staff Report; and (2) application, plans, maps and other supporting
documents submitted by the applicant (the Land Use Code, the Comprehensive Plan and the
