The portion of the Foothills Campus being proposed for annexation includes academic
and research programs, in equine science, fisheries, and human and animal disease. The
areas planned for further development, tend to be clustered and separated by open spaces
predominated by native vegetation. This promotes a compact development pattern, one
of the key principles of the City Structure Plan. In addition this will define an
development edge along the Foothills making for a more efficient delivery of public
services.
The request for zoning to be CSU, is compatible with the Campus District designation
and with the zoning for CSU's Main Campus.
SURVEYOR'S STATEMENT
I, Steven A. Lund, a Colorado Registered Professional Land Surveyor do hereby state that this Property
Description of land proposed to be annexed to the City of Fort Collins, County of Larimer, State of
Colorado, was prepared under my personal supervision and checking, and that it is true and'correct to
the best of my knowledge, information, belief, and in my professional opinion.
I further state that not less than one -sixth of the perimeter of the area proposed to be annexed is
contiguous to the boundary line of the City of Fort Collins, County of Larimer, State of Colorado.

COMMENCING at the East Quarter Corner of said Section 17 and assuming the East line of the NE1/4

Coordinate System, North Zone, North American Datum 1983/92, a distance of 2639.67 feet with all

Provided, however, that:
A. The jurisdiction of the City of Fort Collins shall extend over the property annexed
in so far as it relates to the application of:
I. City traffic ordinances; and
II. City ordinances relating to police enforcement of the traffic code, City
ordinances relating to offenses against the person, offenses against public
peace, offenses relating to morals, offenses relating to public health, and
safety.
The jurisdiction of the Municipal Court is extended to include violations of
ordinances included in the foregoing items A.I. and A.II of this paragraph
occurring on lands so annexed; providing, however, that nothing contained in the
annexing ordinances shall be construed to limit the authority of the University
officials, to exercise the authority provided in C.R.S. 23-5-107 and C.R.S. 23-5-
108.
B. Notwithstanding the foregoing provisions, the jurisdiction of the City shall
expressly extend to the application of the City of Fort Collins Sales Tax
Ordinance on the property annexed pursuant to this petition; provided, however,
that all sales to the State of Colorado, its departments or institutions and the
subdivision there of, in particular the Colorado State University System Board of
Governors, in their governmental capacities only, and all sales, the taxation of
which is prohibited by the Constitution and the laws of the State of Colorado,
shall be exempt from the payment of such sales tax; and provided further, that the
City of Fort Collins shall not impose or collect a sales tax on said property in any
area or in connection with any function where the State of Colorado does not
impose and collect a sales tax.
C. The Petitioner and City shall cooperate in a mutually beneficial manner to share
information regarding plans for new development; provided, however that
nothing set forth in this Petition shall be deemed to confer upon the City a right to
review and/or approve development on the Property.

PETITION FOR ANNEXATION
THE UNDERSIGNED hereby petitions the council of the City of Fort Collins, Colorado
for the annexation of an area, to be referred to as the South Foothills Campus Annexation (at the
CSU Foothills Campus) to the City of Fort Collins. Said area, consisting of approximately
239.57 acres, is more particularly described on Attachment "A", attached hereto.
The petitioner alleges:
That it is desirable and necessary that such area be annexed to the City of Fort
Collins.
2. That the requirements of Sections 31-12-105, C. R.S., exist or have been met.
3. That not less than one -sixth of the perimeter of the area proposed to be annexed is
contiguous with the boundaries of the City of Fort Collins.
4. That a community of interest exists between the area proposed to be annexed and the
City of Fort Collins.
5. That the area proposed to be annexed is integrated with or capable of being integrated
with the City of Fort Collins.
6. That the petitioners herein comprise more than fifty percent (50%) of the landowners
in the area and own more than fifty percent (50%) of the area to be annexed, excluding public
streets, alleys and lands owned by the City of Fort Collins.
The petitioner specifies as a condition of the proposed annexation in no sense shall be
interpreted as:
Conveying to said City any right, title, or interest in the property to be annexed.
2. Conveying any right to establish new streets or extend existing streets upon or
across said property; or to construct utility lines of any kind upon or across said
property.
3. Granting any right to apply the provisions of any municipal ordinance, and
specifically any building code, zoning code, land use code, or any tax or licensing
ordinance, upon the above described property so long as title thereof shall remain
in the Colorado State University System Board of Governors.
