Project Description
Weiner Annexation & Zoning
This in an involuntary annexation. The area to be annexed is the entirety of an
enclave that has been surrounded by the City of Fort Collins for more than three
years, therefore there is no annexation petition required for this annexation. -
In accordance with CRS 31-12-106 Annexation of Enclaves, Partially Surrounded
Land, and Municipally Owned Land, when any unincorporated area is entirely
contained within the boundaries of a municipality, the governing body may
by ordinance annex such territory to the municipality without complying with:
• CRS 31-12-104 Eligibility for Annexation; or
• CRS 31-12-105 Limitations; or
• CRS 31-12-108 Setting Hearing Date; or
• CRS 31-12-109 Hearing,
if said area has been so surrounded for a period of not less than three
years; except that notice of the proposed annexation ordinance shall be given by
publication as provided by section 31-12-108, however for notices of annexation
petitions and resolutions initiating annexation proceedings, no public hearing on
the proposed annexation ordinance shall be required, and the first publication of
notice shall be at least thirty days prior to the adoption of the ordinance.
It is the intent of the City of Fort Collins to process this annexation with the same
hearing process the City typically uses for annexations, regardless of the City's
ability to shorten that process as allowed by CRS 31-12-106. The only difference
between this involuntary annexation and a typical voluntary annexation will be
that the application does not include a petition for annexation.

There are two properties (5117 Ziegler Road and 5305 Ziegler Road), totaling 7.55 acres in
size, that are located on the west side of Ziegler Road, between Kechter Road (to the
south) and Rock Creek Drive (to the north). Fossil Ridge High School is directly to the east,
across Ziegler Road. They are currently properties that are developed as single-family
residences with several outbuildings. The property at 5117 Ziegler Road,contains an
operating livestock feedlot and the property at 5305 Ziegler Road contains a commercial
business (Express Concrete). The McClelland's Channel runs along the south property line
of 5305 Ziegler Road. The proposed zoning for this annexation is LMN - Low Density
Mixed -Use Neighborhood.
A request of the City of Fort Collins to approve the annexation and zoning as
indicated.
A statement as to why it is necessary and desirable for the City of Fort Collins to
annex the area.
A description of the zoning classification being requested and any conditions
requested for that zone district classification.

3 signed mylar copies must be submitted to the Current Planning Department in
between the City Council's 9st and 2nd Readings of the Annexation Ordinance.
The annexation map must show the boundary of the area proposed to be annexed
including the following:
- Location of ownership tracts and platted lots.
- A written legal description of the boundaries of the area.
- A written legal description of the boundaries of each of the proposed zone
districts within the area to be annexed.
- The continuous boundary of the City of Fort Collins next to the boundary of the
area proposed to be annexed.
- A vicinity map showing the proposed annexation and surrounding area.
- All existing structures on the property proposed for annexation.
- All contiguous section line county road right-of-way must be included within the
annexation (i.e. the boundary of the annexation shall not be located along the
center line of a county road).
- The requirements of the above statement also apply to State and U.S. Highways
and if such highways are included in the annexation, the Colorado Department of
Highways must sign the Annexation Petition.
- Railroad rights -of -way contiguous with annexation boundary must be included in
annexation.
