There is a piece of property located at the southwest corner of the intersection of Interstate
Highway 25 and Harmony Road that is the subject of a Petition for Annexation into the City of
Fort Collins. The petitioner for this annexation is Mr. Jay Stoner, petitioning on his own behalf,
and for a number of other property owners. As I understand it, a portion of this property is also
the subject of a reclamation permit issued by the State. I think this is the northern most portion
of the property, and more specifically, is the property abutting, and to the south of the property
being operated as a nursery on Harmony Road.
If any of the property which is the subject of the annexation petition is ultimately annexed into
the City, and if a Project Development Plan is approved for either the ultimate development of
this property or for some interim site work and grading in anticipation of development, this
Project Development Plan would have to be approved by the City to ensure that it is in
compliance with the City's Land Use Code and other applicable ordinances, including the City's
drainage laws. Following approval of a Project Development Plan, the City would monitor the
work being done to ensure that it comports with the approved plan. The jurisdiction of the City
extends only to monitoring grading and other development of the site to ensure compliance with
the City's laws, but does not including monitoring to ensure compliance with any State issued
reclamation permit or other work which falls within the jurisdiction of the State of Colorado.
