on September 17, 2009. The purpose of this request is to allow the property owner
a`aequate time to complete his request to become the Succession Operator with the
State Division of Reclamation Mining & Safety ("DRMS"), and file a request for an
amendment of the DRMS permit so that he may correct violations which he has
admitted causing on the property. Once these two processes have been successfully
filed with the State DRMS, Lafarge will withdraw its objection to the case proceeding
through the City of Fort Collins.
The activities occurring on site, as well as those to be permitted through the proposed
zoning, may result in furthering the violation status on the property. Any activities
occurring on site outside the Mining and Reclamation Plans on file with the State DRMS
are a violation. We request a hold on the City Planning and Zoning process so that Mr.
Stoner can assume the role of operator for his property and become responsible for any
and all activities regarding development of the property.
