Dear Planning and Zoning Board Members,
Please consider this request to add the following MMN Type II Permitted
Commercial and Retail Uses with the approved 3425 S. Shields Mixed -Use PDP:
1. Personal and business service shops.
2. Offices, financial services, and clinics.
These uses, in addition to the Type I uses, were incorporated in the design (site,
civil, traffic, utility, etc.) at the PDP submittal and pose no change in our
submitted project.

Dear Planning and Zoning Board Members,
Please consider this request to include MMN Type II Permitted Commercial and
Retail Uses with the approved 3425 S. Shields Mixed -Use PDP. This project
was recently approved by the Hearing Officer through a Type I hearing.
It has become apparent in the last few days that the Type I hearing that the City
guided us through precludes the Type II Permitted Uses illustrated in our initial
(and only) PDP submittal. All design (site, civil, traffic, utility, etc.) was based on
a site plan that included Type II commercial uses. These uses have also been
discussed in detail in city coordination meetings as well as public forums,
including the Neighborhood Meeting and subsequent Type I Public Hearing.
We believe this project has been mistakenly administered as a Type I Hearing,
instead of a Type II Hearing based on recent Code changes pertaining to the
definition of a 'mixed -use project', in comparison to a 'mixed -use building'.
