4. For the benefit of the P.R.P.A., please add the following note to the
Landscape Plan:
"Vegetation within the 60 foot wide P.R.P.A. easement shall be limited to
Ornamental Trees only. Further, no species that exceeds a height of
greater than 15 feet at maturity will be allowed within the P.R.P.A.
easement. And, no shrubs shall be planted within a 25 foot wide radius of
the electrical power line support structure.
Note has been added to the Landscape Plan.
"Shade trees that are planted outside the P.R.P.A. easement shall be
setback from the easement a sufficient distance as to clear the low point of
the power line in the event that the tree should topple over in the direction
of the power line at the time of the tree's maturity.

5. For the benefit of the City Forester, please add the following notes to the
Landscape Plan:
• The soil in all landscape areas, including parkways and medians, shall be
thoroughly loosened to a depth of not less than eight (8) inches and soil
amendment shall be thoroughly incorporated into the soil of all landscape
areas to a depth of at least six (6) inches by tilling, disking or other suitable
method, at a rate of at least three (3) cubic yards of soil amendment per
one thousand (1,000) square feet of landscape area.

• A permit must be obtained from the City forester before any trees or shrubs
as noted on this plan are planted, pruned or removed on the public right-of-
way. This includes zones between the sidewalk and curb, medians and
other city property. This permit shall approve the location and species to
be planted. Failure to obtain this permit may result in replacing or
relocating trees and a hold on certificate of occupancy.

• The developer shall contact the City Forester to inspect all street tree
plantings at the completion of each phase of the development. All trees
need to have been installed as shown on the landscape plan. Approval of
street tree planting is required before final approval of each phase. Failure
to obtain approval by the City Forester for street trees in a phase shall
result in a hold on certificate of occupancy for future phases of the
development.

encasement and no insulation. Will the concrete encasement provide adequate
protection from freezing?

3. My notes from the meeting with the City Forester and representatives from
P.R.P.A. indicate that the Ornamentals within the P.R.P.A. easement would be
limited to Cockspur Hawthorne or Coralburst Crabapple. The plans now indicate
Tatarian Maple, Autumn Blaze Pear and Indian Summer Crabapple. Be sure to
verify with Tim Buchanan, City Forester, that these trees will not exceed a height
to interfere with the overhead power line.
Trees shown are per Tim Buchanan's recommendation.
2. The floodplain map in the drainage report is not correct. There has been a
LOMR for the Oxbow Levee project that has removed this site from the 100-year
floodplain. Please include a copy of the LOMR map, showing the site location.
The LOMR map has been added.
3. The Plat includes a note that a portion of the site is in the 100-year floodplain.
There has been a LOMR for the Oxbow Levee project that has removed this site

13'. The utility easement from the new ROW is 9 feet as required. I have labeled it as
so on the side west of the entry drive. See site plan.

plat or construction drawings. Please keep in mind that the attorney for the
Church that is required to sign the attorney certification for the plat, may feel that
PRPA would need to sign off on the plat as an owner of an easement within the
plat boundaries in accordance with attorney certification requirements specified
in the Land Use Code.
[12/18/071 I'm fine with the applicant's response, though I believe some sort of
acknowledgement from PRPA should be received prior to hearing that they don't
object to the project going to hearing (or have no comment/concerns with the
propsal.)
[11/6/07] It appears that the Platte River Power Authority would need to be a
signatory to the plat as well as construction drawings, having an exclusive
easement and facilities within the property boundary.

[3118108] Shouldn't the "future sidewalk" specified to head from the parking lot to
the western boundary of the property be in an access easement on the plat to
ensure the legal right for the property to the west to tie into this sidewalk system?
A cross access easement will be pursued with the adjacent property at the time that the
Church requires additional parking.
