We hereby request a waiver from the requirement to provide a 9' utility easement along
the Hernlock Street frontage. Our justification for the request is as follows:
The Hemlock Street right-of-way is more than adequate to provide access for
utilities adjacent to the property. More specifically, there currently exists 32 feet
of undeveloped ground between the southerly curb and gutter and the southerly
limits of right-of-way.
Due to the small dimensions of the site for the proposed development we would
like to place the proposed building 1 foot from our north property line.
