stalls will be provided for Lot 2. This will reduce the possibility for

The proposed development is to divide the existing residential lot at 621 West Magnolia
into two single family residential lots.
Modification Request:
Section 3.6.2-J(2) of the Fort Collins Land Use Code states that "All public alleys shall
be constructed in accordance with the Larimer County Urban Area Street Standards as
adopted by the City Council by ordinance or resolution, except those public alleys within
the NCL, NCM or NCB zone districts that do not abut commercially zoned properties
and that provide access only for carriage houses and habitable accessory buildings as
such terms are described in Article 4. Dead-end alleys shall not be allowed."
Requested Modification:
The new residential unit on Lot 2 of the Magnolia West Subdivision will gain access
from the alley while the existing residence on Lot 1 will have a new access from West
Magnolia Street and will no longer use the existing alley access. We are requesting that
the requirement to pave the alley be waived because, similar to the existing condition,
one single-family residential unit will access from the existing alley. The existing
condition will be maintained and not worsened.
Modification Review Procedure:
We are requesting this modification in accordance with Section 2.8.2 (H) which states
that the "...granting of a modification would not be detrimental to the public good..."
The proposed condition with this subdivision is equal or better than the existing
condition.
Findings:
Per Section 2.8.2, any findings made shall be supported by specific findings showing how
the plan as submitted meets the requirements and criteria of the Modification Review
Criteria as stated in 2.8.2 (H) as follows:
1) The granting of the requested modification would not be detrimental to the
public good because the modification would result in the alley remaining
the same as it exists and the number of driveways accessing from the alley
are remaining the same.
