Comment from Current Planning: In order to clarify the status of the existing trees along Strauss Cabin Road in the event that a City capital project widens the road in the future, please add the following note to the Landscape Plan: "Existing street trees along Strauss Cabin Road shall remain until such time as the road is fully improved to the Minor Arterial Standard. Even though the dedication of additional right-of-way by Old Oak Estates now causes these existing trees to be in the public right-of-way, the maintenance of said trees shall remain the obligation of the abutting property owner and not the City of Fort Collins. Upon the future widening of Strauss Cabin Road, existing street trees may be removed to accommodate the construction of public improvements. When and if the City of Fort Collins constructs future public improvements to widen the road, new street trees may be planted. At that time, maintenance of the new street trees shall become the obligation of the City of Fort Collins." Only LCUASS variances are listed here. The solar orientation is a Land Use Code modification and will be addressed by the City Planners report. I am not aware of any LCUASS variances needed for this project. Just say none. This Plat will be filed long before the vacation has been approved by City Council. The reception number reference should remain for the Utility/Sewer easement with the District. Since the ultimate 6 foot sidewalk needs to be constructed with this project, the estimate should be for the curb & gutter and 12 foot asphalt lane only. The City will review the estimate and place the final dollar figure in the development agreement as an escrow item which will be due at the time of first building permit issuance on any of the lots.
