This drain line was not a part of the Willow Brook design and was not included in the original escrow calculation, therefor we feel that no part of the storm drain is justified as reimbursable. The cost estimate that you provided (prepared by SEBI) shows that the "Willow Brook" portion of the road construction including water and storm drainage improvements totals $63,557. If you remove the storm drain improvements portion of that estimate ($19,850) you are left with $43,707 in construction costs. Very close to the $46,000 we have available in the escrow account. Because Matt Baker is out we don't know if these numbers are so close purely by coincidence or if this was all considered when the money was collected. Either way it appears that the City does have enough to reimburse you for the "Willow Brook" obligation to construct Big Dipper. Please stay in contact with Mark regarding the process to file for the reimbursement of your construction costs. It is my understanding that you have one year from the completion of the road to file for this reimbursement and there is certain documentation that needs to be submitted. The last undetermined cost for your project now is for the Strauss Cabin frontage obligation. Since you will be constructing the "ultimate" sidewalk on Strauss Cabin we will only be collecting money for the "local" street portion which is curb & gutter and 12 feet of asphalt. You will also be eligible for reimbursement from street oversizing for 1.5' of the sidewalk since you are only obligated for a "local" sidewalk which is 4.5' wide. You will need to submit a cost estimate for the curb, gutter and asphalt for us to review. That final dollar amount will be put into the development agreement and the payment will not be due until you pull a building permit for any of the lots. Looking more closely at the Willow Brook development agreement it says that with Phase I of development the City would collect an escrow of approximately $67,000 for the future construction of three street stubs, those being Northern Lights (north of Galileo), Rock Creek (east of Norther Lights) and Big Dipper (east of Northern Lights). We know that Rock Creek was completed recently and the City reimbursed the developer at total of $22,000 (leaving roughly $45,000 in the escrow account at the City). It has also come to our attention that the Northern Lights stub into the Brookfield development was also built about 5 years ago. I have learned that the Brookfield development actually constructed that road rather than Willow Brook. We are not aware of any agreements between Willow Brook & Brookfield and we don't know who paid for that construction but neither has come to the City to request any sort of reimbursement and since the road was completed nearly five years ago it is too late to file for a reimbursement. That being said, this means that there is still roughly $46,000 of escrowed funds in the City account that can be used toward completing the Big Dipper connection.
