Re: Old Oak Estates Development Proposal
Dear Mr. & Mrs. Hutchison,
We understand that you are proposing to develop your 5 acre parcel located at 5227 Strauss Cabin
Road into 6 separate parcels that also includes a new city street, Big Dipper Drive, that will be located
on our common property line. Your project will cause significant damage to us as it is currently
proposed, such as:
1. The elimination of our current lot access point off Strauss Cabin Road
2. The elimination of our current rural open land views to the north
3. The addition of traffic noise from Big Dipper Drive, within 50 feet of our house
4. The elimination of over 160 trees along our north property line
5. The elimination of our existing north fence line that runs over 600 feet
6. The significant reduction in off-street parking space for our business that has been operating
here since 2003
7. The elimination of adequate semi -truck off loading space needed for the operation of our
business that has been operating here since 2003
8. The elimination of a path that allows safe, wheelchair access for our handicapped daughter to
travel to her neighborhood school (Zach Elementary)
9. The elimination of adequate space for our daughter's handicap school bus to turn around
10. Potential interruption to the operation of our business during the execution of the project
11. Storm water run-off will flow unchecked from Big Dipper Drive on to our property
As your closest neighbor, we will definitely be making comments to the City, County and the Judge
reviewing your project for approval. If you wish our comments to be supportive of your project, then
we will need to come to an agreement on how the damages to us will be mitigated. Our expectation is
that you will mitigate damage to us by the following actions:
1. Move our driveway access to a new point along Strauss Cabin Road (preliminary approval
already given by the county)
2. Plant trees north of our house and yard to block the urban view caused by your development to
the north
3. Construction of a sight and noise barrier fence along the south ROW line from Strauss Cabin
Road to the rear fence line of our back yard.
4. Relocate our 160 plus trees south to a line south of the ROW for Big Dipper Drive
5. Relocate our north fence line to the south ROW line for Big Dipper Drive
6. Move our produce cooler to a new location on the south side of our property
7. Construct a new off-street parking lot equivalent in capacity to the one being eliminated (15
parking spaces)
8. Construction of a safe, ADA accessible path for our daughter to travel in her wheelchair to
school (sidewalk south of Big Dipper Drive or crossing signals to gain safe access to the north
sidewalk, one near Strauss Cabin Road and a second one at the green belt side walk crossing
east of Northern Lights Drive)
