please read the attached letter that was sent to us.
Out of the list of concerns - i would think that the county engineering department would mainly be able to
address/have input on the access and drainage comments - comments 1 and 11.
- Marc Lyons is working on the access questions/concerns right,now. I think he may be considering
allowing them to keep an access off of CR 7.
- I should probably look at any drainage impacts so could you keep me posted on how the design engineer
will make sure that there will not be negative drainage impacts to this site.
It seems that many of their other concerns are compatibility and or planning issues.
as far as ZONING goes, do you know what business are they operating out there????? I wonder if this is
a legal business and gone through the approp. county process (see comments 6 and 7)

Here's an email exchange between Traci Downs, County Engineering, and myself. She had asked if I
could find any info out about the business use and whether it was allowed by zoning. I did not find
conclusive information about whether this is or isn't a "legal" use. I do not know if Code Compliance has
or will investigate this use.

Hi Traci,
I just took a look at the Balliew's letter. The zoning is FA-1 Farming. I do not see any information about a
business use on this property in Permits Plus. Farm uses are allowed, but I can't tell if they have some
type of farm use or not. The Assessor's office is appraising this property as a "residential improved"
parcel.
Now that I've left you the voice mail, I scrolled further down the email and found the Balliew's website for

It appears that they are running some type of retail business selling fruit that is imported from other
locations in Colorado and the United States, essentially a "to -order" grocery store for fruit, with customers
coming to the site to pick up their orders. I do not know if they also ship the fruit or if it is only available by
customers picking it up at their location on County Road 7. This type of retail use is not permitted in the
FA-1 zoning district. If they raised all of the fruit on -site, then they could have a "stand for the sale of farm
products produced on the same premises". They say that they established this use in 2003; 1 do not
know if this would have been considered a "home occupation" use in 2003, but my guess is "not". It
does not meet our current home occupation criteria. I did not find any record of zoning approvals for this
use in Permits Plus; if they had gone through some type of review in the past few years, it should be in our
system.
I've cc'ed Code Compliance on this e-mail so that they are aware of the situation. I do not know if they
would investigate this without a complaint being filed. From the tone of the letter, it sounds like this will
potentially be an issue for the Balliew's and for their neighbor who is proposing a development within city
limits.
