The Custom Blending Project Development Plan complies with the Harmony Corridor Plan and the Harmony Technology Park Overall Development Plan, Third Amendment. C. The Custom Blending Project Development Plan complies with all applicable district standards of Section 4.26 of the Land Use Code, (HC) Harmony Corridor zone district. D. The Custom Blending Project Development Plan complies with all applicable General Development Standards contained in Article 3 of the Land Use Code, DECISION The Custom Blending Project Development Plan, #1-08 is hereby approved by the Hearing Officer without condition. Ca'meron Gloss Current Planning Director Custom Blending @ Harmony , ech Park PDP Administrative Hearing Findings, Conclusions, and Decision March 28, 2008 Page 4 of 5 Technology Park O.D.P. to amend the existing Plan by incorporating two former residential out parcels, shifting primary and secondary uses among various parcels and re -aligning Timberwood Drive. With the two new parcels, the size of the O.D.P. increases by 3.7 acres for a new total of 274 acres. The parcel is located within the Basic Industrial and Non -retail Employment Activity Center as designated on the Harmony Technology Park, O.D.P., Third Amendment. 2. Compliance with Article 4 and the HC — Harmony Corridor Zoning District Standards: The Project Development Plan complies with all applicable requirements of Article 4 and the HC zone district. The Staff Report summarizes the PDP's compliance with these standards and no specific evidence was presented to contradict or otherwise refute the compliance with Article 4 or the HC District Standards. In particular, light industrial is a permitted primary within the HC zone district subject to an administrative review. The proposed building location and orientation meet the applicable standards and the building height complies with the standard and is found compatible with the character of the surrounding area. 3. Compliance with Article 3 of the Land Use Code — General Development Standards The Project Development Plan complies with all applicable requirements of Article 3, including the plat standards of Section 3.3.1, and no evidence was presented to contradict the statements and conclusion of the staff report concerning compliance or to other refute the compliance with Article 3. The plat provides for'direct vehicular access from a street and the new'lot lines are substantially at a right angle or radial to the street. The plat indicates that dedications for drainage and utility easements, and right-of-way for Precision Drive, are provided as needed to serve the lots. SUMMARY OF CONCLUSIONS A. The Custom Blending Project Development Plan is subject to administrative review and the'requirements of the Land Use..Code (LUC). W: H-C; Vacant — Harmony Technology Park O.D.P. The following approvals have been granted: • Harmony Farm Annexation - 1984 • Harmony Technology Park O.D.P. (155 acres) — August, 1997 • Celestica P.D.P., - November, 1997 (Intel) • Kendall -Harmony Annexation — June, 2000 • Johnson -Harmony Annexation — July, 2000 • Harmony Tech. Park, First Amended O.D.P. (267 acres) — September, 2000 • Harmony Technology Park P.D.P. (61 acres) - May, 2001 , : • Harmony Technology Park, O.D.P., Second Amendment — May, 2004 The Second Amendment added.three residential properties and increased the total acreage of the O.D.P. from 267.19 acres to 270.19 acres. The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the hearing at approximately 5:00 p.m. on March 28, 2008 in Conference Room B, 281 N. College Avenue, Fort Collins, Colorado. HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE: The Hearing Officer accepted during the hearing the following evidence: (1) Planning Department Staff Report; (2) application, plans, maps and other supporting documents submitted by the applicant and the applicant's representatives to the City of Fort Collins; and (3) a tape recording of the public hearing. The LUC, the City's Comprehensive Plan (City Plan), and the formally promulgated policies of the City are all considered part of the evidence considered by the Hearing Officer. The proposed building would contain about 35,000 square feet and be divided into office and light industrial functions. The office component would be two -stories and the industrial component would range in height from 28 to 38 feet. The facility may expand to 50,000 square feet in the future. The site is located south of Harmony Road and west of Lady Moon Avenue, and part of Parcel E on the Amended Overall Development Plan.
