The annexation map must show the boundary of the area proposed to be annexed
including the following:
a) Location of ownership tracts and platted lots.
b) A written legal description of the boundaries of the area.
c) A written legal description of the boundaries of each of the proposed zone
districts within the area to be annexed.
d) The contiguous boundary of the City of Fort Collins next to the boundary of
the area proposed to be annexed.
e) A vicinity map showing the proposed annexation and the surrounding area.
f) All existing structures on the property proposed for annexation.
g) All contiguous section line county road rights -of -way must be included within
the annexation (ie. The boundary of the annexation shall not be located
along the center line of a county road).
h) The requirements of 'T' also apply to State and U.S. highways and if such
highways are included in the annexation, the Colorado Department of
Highways must sign the annexation Petition.
i) Railroad rights -of -way that are contiguous with the property boundary to be
annexed must be included within the annexation. The requirements of (a)(b)
of this sheet must be satisfied even if railroad rights -of -way are part of the
annexation.

eight hundred 800' et of the property lines of the parcel of land proposed to be
annexed, exc save of public right-of-way. Two (2) lists shall be typed on mailing
labels (33 per sheet), the other list shall be a reproducible copy of those labels.
(Annexations larger than 40 acres shall provide lists of all owners of record of real
property within one thousand (1000') feet of the property lines of the parcel of land
proposed to be annexed.

1) Petition for annexation (original and 10 copies). The petition for annexation and
zoning must be signed by persons comprising more than 50% of the landowners in
the area and owning more than 50% of the area. The annexation petition must
contain the following information:
a) A statement indicating that the requirements of the Colorado Annexation Act
have been met.
b) A statement indicating the signers of the petition comprise more than 50% of
the landowners in the area and own more than 50% of the area.
c) The signatures and addresses of such owners.
d) The date of signing each signature.
e) The affidavit of each circulator of such petition that each signature is the
signature of the person whose name it purports to be.
f) A request of the City of Fort Collins to approve the annexation and zoning as
indicated.
g) A statement as to why it is necessary and desirable for the City of Fort
Collins to annex the area.
h) A description of the zoning classification being requested and any conditions
requested for that zone district classification.
i) A statement of consistency of the requested zoning to be structure plan.
2) Statement of Principles and Policies and consistency with the city Structure Plan
(original and 3 copies) being achieved by the zoning of the property to the zoning

3) List of Names, Addresses, and Phone Numbers of any retailers located within the
boundaries of the annexation (4 copies).

Electric service will be transferred from Public Service Co. (Xcel) to Fort Collins Electric
Utilities. Customers will be notified when the change will occur. Fort Collins Utilities
will provide a comparison of electric costs if you contact them at (970) 224-6152 or
dmartine(a)fc og v.com and provide a copy of your electric bill.
Utilities - Stormwater 221-6700
The Fort Collins Stormwater Utility will be billing property owners a monthly
stormwater utilities fee, similar to the monthly Stormwater fee charged by Larimer
County. The stormwater fee is assessed based on a formula that includes a base rate,

property.

No changes are proposed to the existing services.
Zoning 221-6760
The properties in the enclave area will be placed in the City's CL —Limited Commercial
Zone. The Limited Commercial Zone generally corresponds to existing commercial
activities, where additional infill or redevelopment may be possible.

Annexation Date
The proposed annexation is estimated to be effective in mid -June 2008.
Building Permits 221-6760
The City and County follow a similar building permit process with similar costs. You
may obtain detailed information and a building permit at Neighborhood and Building
Services, 281 North College Avenue. Information on building permits is available at

Fire Protection 9-1-1 for emergencies.
Poudre Fire Authority will continue to handle fire protection issues and calls. PFA's non -
emergency number is 221-6570. For inspections, fire prevention call 416-2890.
Police Services 9-1-1 for emergencies and crimes in progress.
The Fort Collins Police Department will provide law enforcement services to the

Sales Tax 221-6780
If you currently collect state sales tax, you will need to obtain a City sales tax license and
begin collecting City sales tax on the effective date of the annexation. There is no charge
for the license. See http://fcgov.com/salestax for more information.
Sign Code 221-6760
Permanent signs that do not meet the City sign code must be brought into compliance
within seven years following the annexation.
Portable and vehicle -mounted signs, banners, pennants, and signs with flashing, moving,
blinking or other animation effects must be removed or made to conform within 60 days
of the effective date of the annexation.

• CRS 31-12-109 Hearing,
If said area has been so surrounded for a period of not less than three
years; except that notice of the proposed annexation ordinance shall be given
by publication as provided by CRS 31.12.108, however for notices of annexation
petitions and resolutions initiating annexation proceedings, no public hearing on
the proposed annexation ordinance shall be required, and the first publication of
notice shall be at least thirty days prior to the adoption of the ordinance.
It is the intent of the City of Fort Collins to process this annexation with the same
hearing process the City typically uses for annexations, regardless of the City's
ability to shorten that process as allowed by CRS 31-12-106. The only
difference between this involuntary annexation and a typical voluntary
annexation will be that the application does not include a petition for annexation.

The properties located at the northwest corner of North Shields Street and West
Vine Drive (1104 and 1108 West Vine Drive and 723 North Shields Street),
totaling 4.84 acres are surrounded by City of Fort Collins boundaries on all
sides. The properties at 1104 and 1108 West Vine Drive contain an office
building and storage warehouse. There are two single-family residences and an
outbuilding on property at 723 North Shields Street. A portion of the Fort Collins
Irrigation Ditch crosses the 723 North Shields Street property. The proposed
zoning for this annexation is CL — Limited Commercial District, which is
consistent with the recommendations from the adopted Northwest Subarea
Plan. The properties will be placed in the Residential Neighborhood Sign
District.
This is an involuntary annexation. The area to be annexed is the entirety of an
enclave that has been surrounded by the City of Fort Collins for more than three
years, therefore no annexation petition is required for this annexation.
In accordance with CRS 31-12-106 Annexation of Enclaves, Partially
Surrounded Land, and Municipally Owned Land, when any unincorporated
area is entirely contained within the boundaries of a municipality, the
governing body may by ordinance annex such territory to the municipality
without complying with:
• CRS 31-12-104 Eligibility for Annexation; or
• CRS 31-12-105 Limitations; or
• CRS 31-12-108 Setting Hearing Date; or
