Jamie cc'd me on the email, so I've read it. I don't have a problem with it. I've already issued the sign
permit to Jamie, so it seems somewhat after -the -fact.
Here's the description of work which appears on the sign permit:
"Remove existing off -premise monument sign and construct new off -premise sign about 15' further south
New sign to be of the same size and overall height as one to be removed (97.5 s.f. per sidd, 14' overall
height) and contain stone facade. The new sign is authorized pursuant to Zoning Board of Appeals
variance #2620, approved 7-10-08. Existing sign is being removed and reconstruced in order to
accomodate a sidewalk paralleling Harmony Road. Required mitigation trees are being planted in
compliance with Zoning Board approval. Once the sign and trees are inspected and found to be in
compliance with this permit, the City will recognize the sign as a legal, nonconforming sign."

Ted,
I forwarded the revisions of the sidewalk easement that you dropped off the other week onto my corporate
boss and attorney for their review. They are fine with the revised location sketch and legal description.
However, they would like more clarity as it relates to the last paragraph of page 2 of your letter dated
11/21/08. 1 have included their suggestions below on how they would like to see that paragraph rewritten:
The City of Fort Collins agrees, in exchange for the granting of this easement, to issue all permits and
approvals necessary for the construction and operation of a new off -premise monopole billboard structure
on the property, made of steel construction with a stone facade. The City agrees that the new billboard
will be recognized as a legal, non -conforming sign. NextMedia agrees to plant one new tree and relocate
three additional trees in compliance with the decisions made by the Zoning Board of Appeals. I have full
authority to bind the City of Fort Collins to the terms described in this agreement.
Once these changes have been made to your letter and resubmitted to us to review then we will have the
agreement properly executed and returned to you.
