PROPERTY TO BE DEDICATED TO THE CITY OF FORT COLLINS A tract of land located in the northwest quarter of Section 1, Township 6 North, Range 69 West, of the Sixth Principal Meridian, City of Fort Collins, Larimer County, Colorado, the said tract is also located in Lot 2 of the Replat Of Part Of Tract B Fairway Estates Third Filing a plat'of record with the Clerk and Recorder of the said Larimer County, more particularly described as follows; The North 22.50 feet of Lot 2, Replat Of Part Of Tract B Fairway Estates Third Filing. Containing 4,579 square feet more or less, and being subject to all easements now existing or of record. I hereby state that the above description was prepared by me and is true and correct to the best of my professional knowledge, belief and opinion. If acceptable, please sign and return the Easement Dedication to the City of Fort Collins without delay for recording purposes. As you are aware, the apartment building at Fort Collins Supportive Housing is occupied and there is a clear need to have a continuous sidewalk to Hogan Drive for the benefit of the disabled tenants. The City of Fort Collins Zoning Department agrees to grant the Sign Permit for the new billboard, in its new location, with steel construction and a stone fagade, provided that the Permit Application complies with the decision of the Zoning Board of Appeals'. Further, the City agrees that the new billboard, once properly permitted and installed, will be recognized as a legal, non -conforming sign. Again, thank you for your cooperation. College Ave. PO Box 580 Fort Collins, CO 80522-0580 970.221.6750 970.224.6134 - fax fcgov.com/Currentp/anning As per your request, the City of Fort Collins has revised the location, size and shape of the sidewalk access easement so that the proposed sidewalk can now run in a straight alignment parallel to East Harmony Road versus meandering around the old billboard. This new alignment represents a superior design and we appreciate NextMedia Outdoor participating in good faith in finding a workable solution for all parties. Please find attached the following: 1. Revised Location Sketch illustrating the new Access Easement. 2. Revised Legal Description. These revised documents should accompany the standard City of Fort Collins Easement Dedication form that we delivered to NextMedia Outdoor back in April. The old documents showing a 15' x 48' easement should be discarded. Please note that the access easement is 22.5 feet in width. This includes the existing 20-foot Irrigation Easement plus 2.5 feet so the new sidewalk can be safely separated from the concrete irrigation ditch. This width will also allow for proper alignment with the existing walk constructed by Fort Collins Supportive Housing to the west. The opinion of the City's Professional Land Surveyor is that since the Irrigation Easement did not specifically call out usage of the land for access purposes, and since a portion of the Irrigation Easement is needed for the sidewalk, the entire Irrigation Easement should be brought into the Access Easement.
