We have been communicating with Mr. Nacos about his concerns related to the stormwater easement on his property (on Mail Creek just east of Harmony), and will be following up with him about that further by email this afternoon. Jim Hlbbard and I have conferred this afternoon about this planned approach. It would appear that it falls under criteria which would require a right turn lane. Project has not followed Harmony Corridor plan as far as joint access is concerned. Please comment as to why this was allowed @ this location. Also, I have not heard from FC Storm Water regarding a mtg about the mis-use of the Storm Water Easement @ My property. Collins Accessible Space Housing Project Carrie, Mr. Nacos expressed his concern regarding why the Fort Collins Supportive Housing project was allowed direct access onto Harmony Road without a right turn/deceleration lane off of Harmony Road and also stated that the project did not follow joint access (sharing an access drive with the Nacos property). The Fort Collins Supportive Housing project was approved with 23 apartments for the physically disabled. Per the traffic study for the project, the trip generation for this facility was assumed to be similar to that of a conventional apartment complex (although given the characteristic of the users of the complex being physically disabled, it's a fair assumption to state that the conventional apartment use is conservative). The conventional apartment complex use with 23 units per the Trip Generation manual, generates 160 daily trips, 11 morning peak hour trip ends and 14 afternoon peak hour trip ends. When comparing these numbers to Figure 8-4 of the Larimer County Urban Area Street Standards, the threshold for requiring the right turn lane is not met. The traffic study did take into account the shared access characteristic of the project eventually sharing access to the property to the west (the Nacos property) and assumed a trip generation based on what could be developed on the Nacos property. The amount of traffic generated by the Nacos property is such that a right turn lane would be required. The project initially was designed with a right turn lane, which had to encroach onto the Nacos property due to the limited right-of-way in the area. It was initially approached to have the right turn lane built at this time. As the project progressed, we're understanding that negotiations between the Supportive Housing project and the Nacos' was unsuccessful to obtain the right-of-way necessary to build the portion of the right turn lane on the Nacos property. Given that the Supportive Housing project on its own does not require the need, City staff could not justify denying the approval for the Supportive Housing project to proceed. City staff determined that the project could proceed without constructing the right turn lane. City staff did require that the Supportive Housing project provide funds for the future construction of the right turn lane along its frontage, such that with the development of the Nacos property, they would be reimbursed for the construction of the portion of the right turn lane that is offsite abutting the Supportive Housing project. In addition, the Supportive Housing project was required to grant an access easement on the western boundary of its site such that the Nacos property could legally tie into the driveway upon development. This satisfies the joint access requirement Mr. Nacos is inquiring. Thus, with the funds provided and access easement dedicated, we're satisfied that the Supportive Housing project sufficiently accommodated the Nacos property in lieu of being able to build the right turn lane at this time, and again, the Supportive Housing project on its own does not justify the need for the right turn lane.
