Section 3.3.1(8)(2) — Lots There is no new street right-of-way dedicated by this replat as all surrounding streets were fully dedicated, including utility easements, with the Second Filing. The plat also vacates and re -dedicates numerous drainage and utility easements as necessary to accommodate the proposed office building and the necessary utilities. In general, the replat preserves existing utilities and easements and grants and dedicates additional easements in such a way as to provide adequate area for all affected utilities. C. Section 3.3.1(C)(1) — Public Sites, Reservations and Dedications There are no additional public sites, reservations or dedications needed as a result of this proposed replat. 6. Findings of Fact/Conclusions: A. The request to replat Harmony Technology Park into the Fourth Filing is in conformance with the applicable General Development Standards of Article Three of the Land Use Code. B. There are no applicable zone district standards in the Harmony Corridor zone that pertain to the subdivision or replatting of property. C. There are changes to the development of the parcel which are being concurrently processed as a Minor Amendment. In order to ensure that the site is developed with all proper approvals in place, Staff recommends a condition that the Final Compliance (recording of the plat after proper execution of all required signatures) of Harmony Technology 4th Filing not be granted until approval of Minor Amendment MA-08-000-22. RECOMMENDATION: Staff recommends approval of Harmony Technology Park, Fourth Filing, P.D.P., #7-08, subject to final approval of Minor Amendment MA-08-000-22. 4 The Third Amendment was approved by the Planning and Zoning Board on March 20, 2008. This is a request by two of the five owners of the Harmony Technology Park O.D.P. to amend the existing Plan by incorporating two former residential out parcels, shifting primary and secondary uses among various parcels and re -aligning Timberwood Drive. With the two new parcels, the size of the O.D.P. increases by 3.7 acres for a new total of 274 acres. • Custom Blending, Harmony Technology Park, Third Filing - May 30, 2008. 2. Harmony Corridor Plan: The parcel is located within the Basic Industrial and Non -retail Employment Activity Center. The proposed land use, general office, is a primary use as per the Harmony Corridor Plan. 3. Harmony Technology Park O.D.P. — Third Amendment: The parcel is located within Parcel S of the Harmony Technology Park Overall Development Plan. This parcel is designated for both "Primary Uses" and "Secondary Uses." 4. Compliance with Applicable Harmony Corridor Zone District Standards: The site is located within the H-C, Harmony Corridor district. There are no zone district standards that pertain to the platting or replatting of property. 5. Applicable General Development Standards: A. Section 3.3.1(B)(1) — Lots The Replat reconfigures portions of two existing lots to create one, new consolidated lot. The new lot will continue to have vehicular access to both Technology Parkway and Timberwood Drive. These are two public streets that have been dedicated as right-of-way but not yet constructed. 3 EXECUTIVE SUMMARY: The P.D.P. complies with the Harmony Corridor Plan and the Harmony Technology Park Overall Development Plan, Third Amendment. The P.D.P. also complies with the applicable General Development Standards. COMMENTS: 1. (155 acres) — August, 1997 • Celestica P.D.P., - November, 1997 (Intel) • Kendall -Harmony Annexation — June, 2000 • Johnson -Harmony Annexation — July, 2000 • Harmony Technology Park, First Amended O.D.P. (267 acres) — September, 2000 • Harmony Technology Park P.D.P. (61 acres) — May, 2001 • Harmony Technology Park, O.D.P., Second Amendment — May, 2004 The Second Amendment added three residential properties and increased the total acreage of the O.D.P. from 267.19 acres to 270.19 acres. Development 303 Detroit Street, Suite 301 Ann Arbor, MI 48104 PROJECT DESCRIPTION: This is a request to replat a portion of Lots One and Two of the Harmony Technology Park Second Filing. The original Harmony Technology Park Second Filing was owned and platted by Hewlett-Packard. The property has since been sold to M.A.V. Development Company which would like to re -configure the parcels in order to construct a new four-story office building. This new building is different in size and shape than the original building envisioned by H-P thus triggering the replat. The parcel is 8.79 acres and is located south of Harmony Road, just east of Intel. A new public street, Technology Parkway, would be constructed between Intel and the subject property. The zoning is H-C, Harmony Corridor. The review of the proposed 75,000 square foot office building, and its associated public improvements, is being processed as a Minor Amendment of the Harmony Technology Park P.D.P., approved in May of 2001.
