Justification,
A justification for this request per the Modification Criteria (Section 2.8.2(H)(3) is by
reason of exceptional physical conditions or other extraordinary and exceptional
situations, unique to such property, including, but not limited to, physical conditions. We
believe the proposed project meets this criterion in the following ways:
1. There is an existing 60-foot Platte River Power Authority Easement along Lemay
Avenue.
2. The area between Buckingham Street and the north side of the building will
require adding a concrete drain pan and regarding to allow drainage to work
properly. The area west of Lemay Avenue and the east side of the building will
also require regarding and a concrete drain pan to all proper drainage.
3. Both of these situations prevent the ability to place the building closer to the
rights -of -way.

Build -To Lines

This request is for a modification to the "build -to" line requirements as outlined
in the City of Fort Collins Land Use Code. The modification being requested is
from section 3.5.3 (B)(2)(a) and (b), Relationship of Buildings to Streets,
Walkways and Parking. This regulation reads as follows:
(a) To establish "build -to" lines, buildings shall be located and designed to align or
approximately align with any previously established building/sidewalk relationships
that are consistent with this standard. Accordingly, at least thirty (30) percent of the
total length of the building along the street shall be extended to the build -to line area.
If a parcel, lot or tract has multiple streets, then the building shall be built to at least
two (2) of them according to (b) through (d) below, i.e. to a street corner.
(b) Buildings shall be located no more than fifteen (15) feet from the right-of-way of
adjoining street if the street is smaller than a full arterial or has on -street parking.
ProjectProiect Description
The Mountain View Community Church will be located on 6.35 acres of land on the
southwest corner of Lemay Avenue and Buckingham Street. The property is currently
undeveloped but is surrounded on all sides by existing development. New Belgium
Brewery borders the site on the north, multiple industrial business are to the west and
south. Residential properties border the site to the east. The property is currently
zoned I- Industrial District.
Modification
The proposed building is located approximately 87 feet from the Lemay Avenue right-of-
way line and 58.5 feet from Buckingham Street. The result is that the setback distance
along Lemay Avenue and Buckingham Street is 72 feet and 43.5 feet respectively
beyond the required 15 feet. Therefore, the north side and the east side of the building
does not meet the required 15-foot setback for 30% of the building's length.
The request is for a modification to allow a greater setback along Lemay Avenue and
Buckingham Street frontages.
