In evaluating the request for the Cargill Overall Development Plan, ODP130005, Staff
makes the following findings of fact. -
A. The Cargill ODP is in compliance with the 2.3.2 Overall Development Plan
Procedures and complies with the standards of Section 2.3.2(H)(1) through
(7), summarized as follows:
1. The Cargill OPD is consistent with the permitted uses as well as Article
3 general development standards and Article 4 zone district standards
that are applied at the level of detail required for an ODP.
2. The Cargill ODP does not include any residential uses specifically, but
residential uses are permitted within the L-M-N District. Therefore, if a
residential use is proposed compliance within the required density
range, of such uses will be reviewed at the time of a future Project
Development Plan.
3. The Cargill ODP conforms to the Master Street Plan requirements and
the street pattern connectivity requirements pursuant to Sections 3.6.1
and 3.6.3(A) through (F). The ODP identifies appropriate transportation
connections and conforms to the Transportation Level of Service
Requirements as contained in Section 3.6.4.
4. The Cargill ODP is in compliance with Section 3.6.3(F) and Section
3.2.2(C)(6) that require transportation connections to adjoining
properties from neighboring properties for vehicular, pedestrian, and
bicycle movements.
5. The Cargill ODP does not include any natural areas, habitats and
features within its boundaries and, therefore, no natural area buffer
zones are required.
6. The Cargill ODP is consistent with the Foothills Master Drainage Basin
Plan.
7. The Cargill ODP does not specifically include any residential uses and is
therefore in compliance with the criterion that any standards relating to
housing density and mix of uses will be applied over the entire Overall
Development Plan and not on each individual Project Development
Plan. If residential uses are proposed in the future, then the Cargill OPD
would need to be amended to comply with this standard.

2. Compliance with Article 4 of the Land Use Code — Low Density Mixed -Use
Neighborhood (L-M-N):
The project complies with all applicable Article 4 standards as follows:
A. Section 4.5(A) and (B) — Permitted Uses
The Cargill ODP proposed land uses include the following:
• Existing Cargill Limited Permitted Use and expansion
thereof on parcels A, B, C, and D;
• The existing agriculture use on parcel D; and
• Potential future permitted uses in the L-M-N District, also on
parcel D.
All are complementary and are supportive land uses serving the
neighborhood.
3. Compliance with Article 3 of the Land Use Code — General
Development Standards
The project complies with all applicable General Development Standards; with the
following relevant comments provided:
A. Division 3.4 — Environmental, Natural Area, Recreational and Cultural
Resource Protection Standards
The Cargill ODP site does not include any natural areas, habitats and
features within its boundaries.
B. Division 3.6 — Transportation and Circulation
The Cargill ODP illustrates the access points already established by the
surrounding development. These two access points are multi -modal. In
addition, another pedestrian and bike connection is labeled on the north
end of the property providing access from the sidewalk along Nancy Gray
Ave.
4. Neighborhood Meeting
The neighborhood meeting requirement for this project was waived by the Community
Development and Neighborhood Services Director. The Overall Development Plan
acknowledges the access points already established by surrounding development of the
site and the plan was determined not to create a significant neighborhood impact.

• Cargill ODP complies with the District standards located in Division 4.5 Low
Density Mixed -Use Neighborhood District (L-M-N) of Article 4, required for an
Overall Development Plan.

The subject property was annexed into the City in July 1997 as part of the Timberline
Annexation.

PROJECT DESCRIPTION:
This is a request for consideration of an Overall Development Plan (ODP) for
approximately 30.7 acres of Cargill owned property. The project site is located north of
the T-intersection of Kansas Drive and Drake Road. The Cargill ODP reaffirms the
points of access established by the surrounding development and acknowledges the
site will be developed in two or more phases.
RECOMMENDATION: Staff recommends approval of the Cargill Overall Development
Plan, ODP130005.
EXECUTIVE SUMMARY:
The approval of the Cargill Overall Development Plan complies with the applicable
requirements of the City of Fort Collins Land Use Code (LUC), more specifically:
• Cargill ODP complies with the applicable Overall Development Plan criteria in
Sections 2.3.2(H)(1-7) of the Land Use Code.
• Cargill ODP complies with relevant standards located in Article 3 — General
Development Standards.
