I represent the New Mercer Ditch Company and we have reviewed the Thorland
Subdivision PDP. Also we have reviewed a letter from the engineer for the
property and .have been paid the review fee.
New Mercer is satisfied that the proposed subdivision will not create any

Good Morning!
Steve, Tech Services and I met to talk about your plat this morning Jennifer and we have only one issue
that needs to be resolved prior to scheduling the hearing. Tech Services does have some redlines at the
front counter for pickup but all of their comments can be addressed in Final Compliance.
The ownership of the ditch is still vague. We are not sure who owns it and who needs to sign off on the
plat and utility plan set. The plans currently show a signature block for the New Mercer Ditch Company
but from what we understand, this is a private lateral and New Mercer will not be the entity signing off on it.
We do have a letter from Gene Fischer stating that New Mercer does not have any issues but this letter
was written based on the old layout. Recent discussions with JR Engineering and yourself since then
have put some doubt on who exactly owns the ditch and who needs to sign the plans or provide the letter
of intent. To complicate things just a little bit further, we have made some changes to the plans since the
last round of review in that there will now be a 20' Utility Easement overlapping a 20' Private Ditch
Easement.
Steve can schedule your hearing for June 11 th (Wednesday) at 5:30 p.m IF we get documentation of the
ownership of the ditch and a letter of intent from that person or persons stating that they are ok with the
proposed easements as shown on the latest revision of the plan sets. The city needs to verify that the
ditch company is comfortable with the overlapping easements.
We will need this information by next Wednesday the 28th by 10am in order to keep the hearing date on
June 11 th. Please feel free to write or call if you have any questions.
