I am writing to respond to your special request to ask staff one week into staff review of
your revisions whether the project is ready to go to administrative hearing. I have polled
staff members and, while most of us are ready to go to hearing, I must caution you, as I
have done before, that you do so at your own risk.
You will not be allowed to pull building permits to construct this project unless FEMA
approves the CLOMR/LOMR you submit. Therefore, the hearing will be conditioned
upon FEMA approval of the project. If the project does not receive FEMA approval, the
hearing approval will be null and void. If the project receives FEMA approval but that
approval involves major changes to the site plan, landscaping or architecture of the
project, then the project will need to go through an additional development review
process which in the best case scenario will be a minor amendment to the approved
plans and in the worst case, will be full project development plan review including
another public hearing.
You have the right to request that the project go to hearing, but you make this choice
assuming all risk involved. Staff has indicated that there are a few items that must be
addressed before we can schedule the hearing, which I have attached. Once these
items are addressed, please contact me to schedule your hearing. Please call me at
