Option 1 seems to be the one that provides the best solution for both parties. It really is the only option. Where
the fence will go, relative to the property line, is a private matter between the neighbor to the east and you.
From a City standpoint Option 2 would not be acceptable. If you were to take down a portion of the fence that is
on your property and not replace it, as your message sounds, then the project would not comply with Section
3.2.1(E)(4) of the Land Use Code that requires you to screen your parking lot from residential uses with a fence
or wall that is 6 feet in height.

I wanted to touch base with you regarding the fence along the east of our client's property — specifically where the
neighbor's fence is on our property. We are holding off any construction work there until we have a clear cut way to move
forward. We are trying to move forward in the least problematic way possible and want to come up with a solution that
works for everyone; however, we cannot wait much longer. We see 2 options here:
Option 1 — We take down a portion of the fence that is on our property, install a temporary fence until the detention pond is
complete and then replace the fence on the home owner's property.
Option 2 — We take down a portion of the fence that is on our property.
Obviously, we do not want to pursue Option #2 at all and are striving for a win win here. Please let me know what you
have found out on your end.

I met with Stacy Phillips, the neighbor to the east. I explained to her what the contractor was planning to do,
which was remove a portion of the wood fence along her west property line and put a temporary fence up (to
confine her dog) until the detention pond, grading work on Aspen Dental is complete. Then the contractor would
replace that section of 6' high wood fence along the property line to the northeast corner of Aspen Dental,
moving it approximately 1.5' to the east (I was unable to find the rebar for the property corner that apparently is in
place). Ms. Phillips, although not entirely happy with the situation, seemed to understand what was going to
happen.
Please remember that a property line dispute is a private matter between the property owners and the City will
not be involved in resolving a dispute. I certainly did not get the impression that Ms. Phillips was going to hire her
own surveyor to check the property line. You may know something different.

Option I is how we all want to proceed but from what I hear, these particular neighbor's are less that willing to
accommodate us in the short run. I was hoping the garner some information from you through your contact with them.
How did your conversation end? Did you direction them one way or another? Did they indicate what they thought they
might do?
Anything you could tell me would be tremendously helpful.
